my polo was attacked yesterday by a nice person in a BMW E46

i'll tall you what happened

the attack happen at 1pm on 24/01/09

i was driving down the road in sidmouth and this bmw pulled out on me so i beeped the horn cuz i had to stop we then carried on down the road

at the next road on the right he indicated to turn up it and started to go up the side road i when to go behind he as there was a lot of space but he then reversed in to me hitting my front wing and wheel i then stopped the car and he done it again to the rear wing .

we then pulled up the side road behind he to sort out the insurance but they they was (saying that why would they roll there bmw into a piece of shit like me car ) my cad asked then for the details and the man then beat my dad up knocking him out and then stamping on his leg which ended up breaking 2 bones in my dads ankle and the doc's think there maybe ligament damages.

are day out ended up in exeter hospital we left the hospital at 8pm

plus i think the polo will be a white off

what should i do now

Did your get the reg of the bmw cause id be ringing the police if you aint already

get those idiots sewed for every penny, i know its no real compensation for your dad, but it may help numb the pain

that is fucking disgraceful...he sounds like absolute scum and that he will surely be prosecuted for what he did!! Well out of order....

Make sure you have the reg of the BMW and a description of the driver if you haven't already got his details.

You need to report this to the police asap, the injuries you described to your dad would constitute GBH or poss GBH with intent, both of which can carry fairly hefty prison sentences.

Really sorry to hear this, as you had so many plans for your car. However, a car is replaceable and you and your family are not! I wish your dad a speedy recovery and I hope the driver of the BMW has justice served upon him.

That is downright disgraceful and I hope your dad makes a good recovery too. As said above you should make sure you get all possible details but judging by the intent with his car, I doubt it was even his.

my mum who was i n the back of the car called the police and they did come to the ceane but they didn't even to a Breathalyzer

and yes the po po got the bmw drivers detail

but i dunno it i wanna go throw the insurance tho cuz my car will be whiten off

and i don't wanna lose my no-claims

but i dunno what i should do

also the steering is out on my polo due to the bmw

You ring your insurance and give them the BMW drivers details and they will get onto his insurance company to get it sorted it won't affect your no claims because your not claiming on your insurance company it will be his that pay out if his is covered.

This definitely is a job for the police. Was the BMW driver still at the scene when the police arrived or had he left?

Were there any independent eye witnesses?

What about CCTV?

How have the police treated your case? i.e are they going to charge the BMW driver with assault and arrest him?

A friend had a similar road rage incident occur to him. Not sure of exact details, but he was in the car with his 2 young daughters. a 4X4 cut him up, he beeped. The 4x4 then proceeded to ram his car several times. The 4x4 driver only backed off when my friend pointed out his 2 daughters. My friend reported the incident to the police. Unfortunately there was no record of the 4x4, it was dodgy.

I hope the same does not happen to you. I hope they treat the incident more seriously given your father was attacked.

About the claim, I'd speak to your insurance company. They will tell you the ins and outs of making a claim and how it will affect you. Also find out if you have legal protection, you might want to be speaking to a solicitor.

Id say definately push the police for a conviction, that is just disgraceful, hope your dad recovers and you get everything sorted with the insurance, but breaking someones leg in 2 places and knocking him out should NEVER be let off especially as there are witnesses

That's a horrifying story mate! I hope your dad makes a full recovery and that it didn't cause him, you or your mum too much shock... As for the car, get yourself a pair of car body suction cups and have your steering given the onceover by a garage, that will be back on the road in no time bud :-)
