car accident with undecleared mods

Featured Replies

Someone pulled out in front of me at a junction and I had no choice but to hit him. There's not too much damage although my 6n2 hybrid bumper is broken which I'm most annoyed about.

When I started my insurance I had no modification but now I have a fair few... coilovers, leather interior and alloy wheels. Would it be best to put back to standard what I can before claiming? I still have standard suspension in the garage and standard seats. I don't have my standard wheels though.

This is my first car and first year of driving, there's not much damage, just needs a new bumper, grill and surround, headlight and maybe the bonnet.

I don't know what to do really, the accident was not my fault as he was coming out from the junction but they are going to send someone out to look at the car and see my blue mini wheels are clearly not standard.

Did the other party take any pics at the scene? Cause if they pull them out and notice you've changed stuff you are fuckeddddd

Technically you have no insurance, but we won't go into that.

Did the person you hit admit the accident was their fault?

If so your insurance doesn't matter as it will be his insurance that will be footing the bill.

If I were you though I'd try and get them to give you a cash settlement and just fix the car yourself as the insurance are likely to write the car off and that is just a pain in the bum.

You will find your insurance is void if the modifications weren't declared, and technically you were un-insured.

If its the bloke from his insurance comapny, he's going to look for any reason he can to get out of paying up and slamming it straight back to you/your insurers.

If i were you I would act as quickly as you can, to cover your own back. you might not be at fault for the accident, but you are at fault for not declaring mods.

declare your mods when this blows over and hopefully count your lucky straws.

Isn't it the case that if you are going at a speed you were unable to avoid hitting something, its deemed your fault?

No. Remember that video of the Lamborghini crash in London earlier in the year? The Mazda which pulled out in front of him was at fault. Regardless of the speed you're going, you have right of way and it's the person who pulls out of a junction without looking who is at fault.

That's coming from someone who works in the industry, by the way.

Yeah I understand what you are saying about not having any insurance with undeclared mods, I am an idiot and didn't want to pay another deposit for insurance to change my policy.

Anyway I'm going to try and put it back to standard as much as I can. Thanks Alex that has given me some hope! lol. There was no way I was speeding and it was wet so not as much grip but he could have just not looked there was no way of knowing.

Thanks for the help guys.

They did say it would be a write off because of the age, there is no way its getting wrote of for a bumper and headlight! I Have lots of parts that I've spent a lot on money on and I'm in love with it too much!

she said something about giving me the money of scrapping it minus 20somthing percent.. Not too sure on the details but its not getting scrapped no mapper what.

I'm going to be taking pictures and making a statement to the insurers in the morning so we will see.

I'd say they will just write it off. No one will come see the car and you'll be left with not a lot of money once it's all done.

They will mark it down as an insurance cat C so once you get the car all fixed up you'll need to take it for a fresh MOT then find your nearest VOSA test centre and get a VIC check.

Sounds easy but all it is is just a lot of hassle.

Plus resale value will be harmed. If you can don't let them write it off. But if I were a betting man I'd say they already have.

Be prepared for the low ball offers they give you. Just say no I want £xxx because that's the cost of a suitable replacement.

Some one my dad knows had a similar thing happen the other day. 1 hour after buying her car. They offered her £6,000 less than she'd paid a hour ago!

Lucky it wasn't you crashing otherwise you wouldn't be on here for a while! (wouldn't be able to afford insurance for a while) At least you've seen the light about mods.

Yeah she said I would have to get the car checked. The m.o.t is only 2 months old which is annoying but I know a guy so it should be ok. I've found all the parts I need from a scrappy for £50 so I'll be happy with any amount of money really. I've spent to much mine to let it go. I've managed to borrow some Steelies from someone in exchange of using my arch roller in case they wanna send anyone to look at ita look at it.

Oh yeah they're my steelies. Is it okay that they're sprayed red? And if I drive them over to you, would you be able to bring them back to me?

Hello mate, yeah that would be fine. No problem! if they do decide to look at the car before paying out I'll tape some hub caps on or something lol.

my insurance company wont be out as my excess is nearly as much as the car is worth. so she has cancelled my claim and said she is going to let me know the decision about who was liable. my dad said that if he's found as being liable that I can claim off his insurance. Do I have to sort that out or is that something my insurance company do? does anyone have any idea if his insurance company look at the car? It probably depends on the case doesn't it?

If he is found to be liable then everything should go through his insurance company, which your insurance company should be able to sort out on your behalf.

But they will do exactly the same as what your insurance would do most probably. Only difference is you won't have to pay your excess and you should keep any no claims bonus.
