When you first rang the police did you mention that the BMW driver had assaulted your dad? If so what exactly did you tell them? Was the BMW driver there at the scene when the police showed up?

Frankly I can't believe that the driver of the BMW broke your dad's leg/ankle, that the police knew this, and that when they turned up the offender was stood there next to them and that the copper managed to take 2 statements (which presumably said that the BMW driver had assaulted your dad) and that the BMW driver just wandered off unmolested.

The injuries described to your dad are a s.18 GBH - the most serious assault short of murder and almost always handled by detectives. As your dad is disabled he is also classed as a vulnerable victim and his case would be prioritised and monitored by an Inspector or Detective Inspector.

If that's how it happened then either the officer who attended will be disciplined and sacked or you're not telling the whole story.

hi yes the bmw driver was there when the police got there

and yes they did know about the attack on my dad my mum was on the phone to the police when the man started attacking my dad

the police woman that showed up didn't do much and the over day when my mum called to see whats happaning with the case they said the police woman that was dealing with it was off on compassionate leave

when my dad fills up to it were going to go to the locale cop shop and try and sort it out

we where hoping that the police that where dealing with it would of sorted it out

the over think is that they didn't tack my dads statement cuz there where supposed to come to the hospital to get it but they never terned up

they trying to sort it out but its going to tack a lot of time as the bmw driver/owner wont let them inspected his car

Got hand controls fitted to my car, they control what ever pedals you cant use (mine being accelerator and brake) if its left leg then just clutch

Bit drastic, but it gets him back behind the wheel sooner

And as for the minimum sentence being 4 years for section 18 then I'm sure he would get out after 10 months or something stupid like that.

not quite mate, its a violent offense so you can't get out on tag so its all down to parole, the first chance for that would be half way through, but even if he didn't get that he would be automatically released after 3 quarters of his sentence no matter what.

he yes i've put a claim in on my insurance i didn't want to but it was the best think to do

we have told the police we want to press charges against the BMW driver

have you got an actual lawyer working with you? cos they will know who to call and what to say to get things moving
