Thats pretty much what I said to the copper in my case.

I said "I felt completely in control of the car, so how do you know how much control I have over the vehicle?"

dangerous driving is a little different, courts hate that,

id hardly say a copper is highly trained. some yes but thats abit of a tarring with a brush situation,

if you have a good solicitor or are good at fighting your own case it really is his word against yours, and in the above situation where he was driving past you he would barely be able to comment on your driving as all he had was a glimpse where as you where the one driving so know whether you where in control.

in my case i drove passed a parked police car just before going in to a national speed limit, he said i was speeding, he also said he chased me into the lanes and hit 90 mph in places and still couldn't catch up with me (which i thought was a bit of an exaggeration but hay ho)

he was only in a 'panda' car so no camera and only him in the car, so in theory it was my word against his. he also had all the logs from the radio conversation to back up his side of events and a very detailed statement. it's never really your word against a coppers, if that was the case you could get away with no end of shit, the word of a police man is worth more than your's in the eye's of the courts, after all it's their job to tell the truth and your just trying to get off a charge of some kind.

not all police are highly trained, but they are all trained to some degree and they have all had to take an oath which will automatically put them in a better position than just your normal citizen if they are facing each other in court. also are they not seen by the courts as an expert witness if they have seen you commit a crime?

i've still got all my paper work stashed away some where which i could dig out (it's been about 9-10 years since i last read it so i can't remember word for word), but it's full of questions being asked the copper like 'in your professional opinion' ect

yes and as i am a qualified driver (with a Drivers qualification licence) Drivers CPC and heavy goods licence any driver questions put forth to me could also be asked as in your professional opinion as in the eyes of the law i am a professional driver so especially in your case where it was a panda car id be seen to be more qualified than him (unless he was a traffic officer for some reason driving a panda car)

i represented myself in court at 16 (a solicitor tried but he was crap so with research in hand i took over) in relation to a drink related motoring offence.

the police tried to prosecute me for drink driving, saying that i had driven the car and it was very clear as the bonnet was hot and the parking light on near a junction,

but with holes i picked in the case and any minute mistake the officer made and making references to previous cases and by no means admitting or denying the offence the judge ruled a minimum sentance for drink related of a 12 month ban. under DR40 (drunk in charge) which should be 10 points and a hefty fine, I got no fine, no points just the ban as that the minimum that can be given, as there was some evidence that secured this prosecution.

but in my opinion that is a result as the charges of driving with invalid MOT and Driving whilst under the influence where dropped and changed to drunk in charge, which is basically that i was drunk in a car with the keys in my pocket (i was actually sleeping in the car after a night out with mates)

if you do your research and fight your case then you can beat an officer who has no actual evidence,

his call of chase could have been thrown out if your solicitor stated the obvious that he could have just been driving behind you at normal pace for a period and said all that over the radio, and if he was heading the other way of course he is going to have to break the speed limit to catch you up as you are doing the speed limit already..
