collision with 3rd party at fault but mods not declared ?

Called insurance today the claims department accused me of not declaring my 3 points!!! even tho i rang up on the 5th jan and did so :-/ had a big argument with them then i rang customer service and they found my details about the points!! what a joke, why are they trying to get out of it when its a 3rd party claim?

I suppose irrespective of it being a 3rd party claim they still have to contribute man power to a case that otherwise in their eyes they shouldn't be spending time on. One thing to note is that while it may be a 3rd party claim, your insurance company aren't actually gaining anything by helping you, there is no insentive for them other than a moral obligation to good customer service, but then they would argue that you also had an obligation to make them aware of modifications etc.

They are a bitch to deal with mate, irrespective of who is to blame or what the issue is. Every single person on this forum will no doubt have some kind of gripe with an insurer at some point in their motoring lives thus far.

Your right mate very thought provoking answer thanks, i got the points situation sorted and the guy said a check for £850 has been sent to me and i get a 7 day hire car till it clears, which is great but i dont want them to take my car :-/ what will happen? its valued at 900 i think

Sounds to me like you have (or they think you have) accepted their first offer on the car. I would stress to them that you think the car is worth more if you do think so. Also while you are there make them aware that you want to keep the car.

Also since they are sending you a cheque you need to ask if they have deemed the car a write off and if so what catagory. You'll need to know this if you are going to sell the car or get it back on the road so there are no nasty surprises.

think id snatch the 850 and run

bet your insurance will go up on the next car as youve still made a claim ieven though its not your fault

It shouldn't go up and if it does then you can fight it. You going to buy the car back off of them?

Well this has been a right pain in the ass ! They said on the phone check has been sent but it never turned up , now there saying that the car is a total right off and valued at 980 but if i want to keep it they charge 245 so I'm left with 735 , fair enough however they want the logbook and MOT Cert . I have the MOT cert just cant find logbook i have found a green slip which i have sent off with MOT but when i rang them they said i may need to apply for one which will cost 25quid! the car is not even in my name yet i have not had it long ! all this faffing about when they could just pay me and case is closed . O and i will need to get the car V.I.C checked

They are charging 25% to buy it back? That's a high rate.

I'd take the wheels off and let it go if it were mine.

So it looks like it was a Cat C, what was the repair quote?

It is high tight barstools :-/ its only got 74,000 miles with full service history from VW and just spent 250 on brakes all round , only reason I'm keeping it :-)

Yes and thats all its worth its got the old interior mine has the new interior it makes a big difference and my interior is immaculate it has no abs mine does and its the 1.6 petrol version mine is the alh tdi engine , also think that one is £120 for 6 month tax mine is just over £70.

I was looking for the right polo 6K saloon for over a year before i found this one , the petrol ones are 10 a penny but find one with the new interior/electric sunroof ,tdi engine,under 80k miles with full vw service history for under a grand is not so easy.

Did you do any research for your insurance to show them how much it would cost you to replace your car to one of the same spec?

Well they valued it at 980 and i have seen one once on ebay down south it was emmaculate with full vw service history , modern interior and had the 110bhp engine ! (Will proberly never see another one with same spec for sale) and i think that was 1750 but it was in loads better condition outside and had the 110 engine wich is worth an extra 350 just because of its rare factor . They devalued mine for things like airbag light been on and rust on the bonnet and abit of peel on the boot , if anything they were out by 150quid but i didnt want to start snooping because of undeclared mods, its finding one with the same spec on the whole internet let alone ebay which is the hard bit! Besides I'm not that bothered about the cat C and in theory the car is costing me 245quid and i will get the work done with abit left over for next service.

I have had that many cars in the last few years that I'm happy with this one now, besides its a solid shell and should last me a fair few years
