I shall make it short and sweet.

I will be driving 2 years on the 17th august next month. I already have 3 points.

I got caught doing 70 in a 50 on saturday (another 3 points and £60 fine)

MY idea is this -

If I pay it within 28 days I will get banned, if I dont, they will make a report and send it to the prosicuter fiscal and which should take a few months. By then I should'nt get banned as I will be past my probation.

Any 1 been in a similar situation?

They could ban you anyway. Definatly worth a trip to a solicitor for this one I'm afraid.

they act on from the date of offence rather than date of conviction......

so yes, they will do you for the offence on saturday.....

hmmm...intresting.

Because I said to the cops when I was in the back of the car, that I need the car for my job.

I quote what the female officer who was driving said

"We're not telling you what to do, but if you don't pay within the 28 days, i will have to send a report to the procuter fiscal, which will take a 3-4 months to process due to the backlog. By this date you will be past your probation period"

My reply

"Can I still get banned"

Her reply

" I never heard of any getting band for this driving offence"

95% is the actual word she said to me. I see that you guys mean, but I see it from the officer point of view as well.

No, according to the DVLA website its 6 or more points within the first 2 years. The other interesting point is that there is NO right to appeal against the revoking of the license only a right to appeal against the individual offence.

6 points in your first to years dosent mean you get a ban, you get your licence revoked and just have to retake your theory test and practical test again.

Do I have to wait for my provisional lisence to come through the door first before I can resit my theory and driving test?

Edit...I have a appointment to see a solicitor. What i don't get is

The cops were about 25 metres away from me on top of a bridge. this was 1pm in the afternoon on the A99(so it was busy)....they was a car in front of me doing the same speed, if not more and a car behind me. How come they are able to get me pinpont. I doubt the officer has 20/20 vision and he a doubt he was'nt as good as john wayne with the speed gun. It was a 2 digit LED screen on the gun tht displayed "70". Was proof has he got thats me?

Erm. . . The thing with the gun I'm not sure about coz as you say it could have been any car so speak to the solicitor regarding tht. I doubt you can appeal sayin that the cars infront and behind were travelling at the same speed coz they will say they wernt which is why they caught you.

I got done 2weeks ago not wearing a seatbelt when I was, I asked how she could see as i was travelling past her and i have tinted windows and i dont think its fair, her reply to me was well who are they going to believe if you took it to court??

Some cops are ok but some think they are above the law, I appologize to the small amount that can be Ok.

Its just pisses me off in a country like this. Legislation is a joke here.

When I passed my test, I sat half over the end of the zig-zag line for 5 mins. Fair enough but I see this everyday going to work, I even seen a police van doing this. I have been travelling 5 days a week since Xmas on the motorway to work and back. THis is the first offence like it and they want revoke my liscense.

What would be the situation, I heard sometimes they will give leverage if you need you car for work, and if you had proof. I heard of them giving 2 points instead of 3. Mabey I could appeal the offence by using that? lol

No you get your licence back with 6 on it but your allowed upto another 6

NBickyboi...how long after your liscense was reoked, how long did it take you get back on the road.

Does any 1 know a loop/ or even possible loop hole about getting out of this. Not bothered about paying a bigger fine!

Well if you reapply for you licence straight away then you should get it back fairly quick, mine took a week to come back.

Apparently your ment to do a minimum driving time of 10 hours before your test and its meant to be extended to 1hr 15-30mins.

I done 2 lessons, 1 before my test just so i didnt have any bad habits n then done the test. They didnt make me do an extended test.

Shouldnt take you too long, all depending how lazy you are!!

Heres one thing you could try. My brother got caught doing 85 in a 70. He wrote to the DVLA I think asking to see the callibration certificate for the camera he was caught on and it was out of date. This emant that they could not prove that the speed reading was accurate and so the points the deducted from this licence. He still had to pay the fine but now still has a clean licence. There is a book you can buy with this kind of advice in it but I can't remember what its called. Good luck with it all though
