Got a Section 59 on monday at the llandudno junction, i had in the tunnel overtaken a lorry and pulled back in, on leaving the tunnels at Llandudno junction i came across a corsa doing 50 in the fast lane, so i carried on in the inside lane at 70ish and carried on passed, noticed that she seemed to be on the phone or arm on the window ledge, and i accelarate away. I get to colwyn bay and a Galaxy unmarked hoves into view and pulls me in for Undertaking at first my attidute was WTF?! then he said hed clocked me at 85MPH which i admitted and he nicely said he wasnt going to do me for that, just for the undertaking so Section 59ed.

Apparently i should have slowed down, pulled out, and flashed the other driver out of the way in a non agressive manner. I didnt ask him what non-agressive flashing was as i couldnt have kept a straight face.

So despite hogging the outside lane on an almost empty dual carrige way she was not doing anything wrong....

(1) Where a constable in uniform has reasonable grounds for believing that a motor vehicle is being used on any occasion in a manner which—

(a) contravenes section 3 or 34 of the Road Traffic Act 1988 (c. 52) (careless and inconsiderate driving and prohibition of off-road driving), and

(b) is causing, or is likely to cause, alarm, distress or annoyance to members of the public,

he shall have the powers set out in subsection (3).

Doesn't sound like you were doing either of these and even if you were, there are plenty of existing laws to use against you. Maybe should have done the other car for incorrect lane discipline. If you stayed in the left hand lane for a decent distance after passing the car in the right hand lane then you haven't broken a law there either.

I tried that one and thats when he quoted the BS at the end about flashing them out of the way.

That's clearly careless driving, you overtake on the right. And that "BS" is the best way to indicate to someone that they are holding up traffic behind them - rather than getting too close to them and creating an insufficient braking distance - which again can be careless and may alarm the driver in front.

flashing in a non aggressive manner? WTF is that all about? Most of the time you find some cock in the fast lane holding everyone up, they ain't paying a tiny piece of attention to whats happening behind them due to them either being a crap driver or being entertained by their phone/stereo/reflection, whatever.

I flash people when they do this and all i get is heavy breaking, stupid driving and threats of violence! next time, i'll undertake too!

have i missed something here... undertaking is illegal in free flowing traffic?

So flashing the person who hasnt realised they are holding up traffic would be the best thing to do? If they dont wanna let you passed, you just pull to the side and let the next guy get right up their rear and push they out the way!

I get tempted to push people on may occasions, especially the people who overtake at 70 on the motorway or pull out into the fast lane miles before they need to and then proceed to travel 2mph faster than the vehicle they're overtaking!

if you see a black G40 coming up behind you - get out the way - quick!

My dads like that, he wont give in, if someones in front of him doing exactly what you said, he'll flash them and everything then we usually get the idiot who will go into the inside lane thinking there shitty 2.0 scarlet or whatever (that was last car that happened i think) is quicker than what they think is a 1.8 Audi A4 convertible, but when its quite clearly a 2.0 Sline that has full stainless, full induction and has been chipped with a Multitronic gearbox thing, just makes me laugh, we let them get ahead a little then driop it into sport and they soon realise what were in. I fckin hate lorries that pull out immediately AS they signal and proceed to overtake over the next mile and a half... Fucks

Mind you... having said that nothing more annoying than when you do go to overtake, at reasonable pace, you get some cock about an inch from your bumper till you have moved across, and they try to drive past you before you have even got in the next lane...I hate slow drivers too but thats just fckin irrtating

at the end of the day no one would call the police unless you were rowdy, abusive, loud or being numbnuts and if you were so innocent why did you not plead the lack of evidence card?

lmao i dunno, i didnt really get a chance to prove myself innocent, just a piece of paper and got told were all getting section 59's..

Anyway, what you did I would do and I think anyone would, did you say she was on the phone? And also reading that she should get a section 59, Vehicles used in manner causing alarm, distress or "annoyance" she did not pull in BITCH!

Seen few undercover cars in Bangor and Llandudno now.
