The police cant be judge,jury and executioner - they have to present a case against you. When questioned,you tell them you disagree,as you clearly do,and will see them in court. There,its you versus the police.

i asked a friend who is an MOT tester:

"from the picture above, yes it is a failure when it comes to the MOT...according to the test, the tyre/wheel width (or sticking out) has to be flushed at the most.

Also, on another wee note, even if the car passed the MOT with the above wheels/tyres, it can still be classed as dangerous and not road-worthy by the traffic police. The British Transport Police have a much stricter road safety test...we could pass a car that has tyres that are low outside the MOT standard, but the cops could deem them as dangerous and take action."

did the police call VOSA to look at your car? because it is vosa not the police who decide if you car is dangerous! the police have to call vosa who come and check your car then and there and if they think it is dangerous then police deal with you if not police have no grounds to stand on! i know this because i asked vosa guy who had to deal with my m8's road/track car once after some none local tosser police officer pulled him over and called vosa out to check his car!!!

go to court!!!!

Was it a traffic cop or a local beat bobby that pulled you over for the wheels? I've found that local beat bobbies never really know what law your breaking. Take it to court and argue the reason as to why its dangerous, there are more things that stick out further than the wheels. Wing mirrors for example.

to me it looks legal. my understanding is 30mm wheel pertrusion but no tyre tread sticiing out at all. but thats an uneducated opinion compiled from many sources.

Exactly, its a pathetic law/rule. I got pulled the other week for wheels pertruding the arches, but luckily didnt get anything.

As said above the MOT is one thing but what the police and VOSA class as dangerous is another thing.

I think you'll find that some police have power to not only decide whether or not your car is unsuitable for the road but also the power to serve a prohibition notice on it and prevent you from driving any further in it. Given that this happened to a friend with something as trivial as tail lights it would have been much the same story had his wheels been poking out into no mans land.

I got stopped 2weeks ago by an off duty copper, (he followed me home!) He told me not to let the old bill touch me for em as he runs them pertruding on his golf.

True but there is nothing to prove that those wheels were on at the time of the MOT

The whole stretch and poke thing is a grey area... At the moment it seems you will get away with it as long as you aren't taking the piss, which some people blatantly are

Foxie if you wish to go to court this is what you need to do so you don't get 3point i think this alone is worth fighting for!

To prove your car is not dangerous

It is your responsibility to ensure that your vehicle is road worthy at all time and to do this you get your car examined every 12 months by a VOSA approved testing centres!

1. Get your car MOT'd with the wheels on and get something to prove this!

If your car passes

2. Go to court

you then have evidence that you where not driving a car that was dangerous under your knowledge because your car has then been tested by an MoT Nominated Tester who accredited by VOSA to assess your vehicle against specific safety criteria and to pass it as acceptable and safe, or not.

Because of this you should not be liable for points. But if your wheels are dangerous you still did take all the necessary steps to ensure your car is safe.

and the fault will then be The Vehicle and Operator Saervices Agency (VOSA) because there responsible for 'licensing' both the MoT test station and the MoT tester.

the above seems a very fair point and will quite possibly help you to not receive the points

i also dont get why he gave you 3 points surely if he thought your wheels are illegal he would of given you 3 points per wheel!! if he pulled you for lets say for example two bald tyres on the rear then thats 6 points 3 for each. so for running in his opinion these child & oap shredding chunks of deadlyness on your car he has only give you 1.5 points each its a joke

the three points don't sound fair at all, i would contend those

it is a really grey area of the law. i was always led to believe that if the tyre thread was under the arch, it was ok... BUT i'm not to sure now?
