Basically to cut a long story short I was caught doing 70mph in a 40 mph zone! ( I know bad boy, I'll not be doing it again thats for sure!)

Got the letter through said it was me driving but asked for the photos and the camera cert.

Looking at the photos they caught me doing 70mph just 150yards from where I started at 0.

Earlier on a piece of private land I worked out roughly 150yards and the best I can get out of my car pushing hard is 63 on the speedo (58 on gps).

But i wasn't pushing hard, and i was going uphill that day, the private land was dead flat.

So my question is, is there any way for me to prove my car is not fast enough to do the speed they are saying in the short distance I travelled?

Also where are the police supposed to aim the target on your car? I though it was the number plate but they are on the front nearside wheel

get a rolling road certificate showing top speed then show them that maybe?

pretty sure its the number plate they have to aim at

I would send them a letter with supporting facts and basicly ask them how they can explain a 1.4 polo doing 0 - 70mph in 150 yards.

I remember watching something on tv about the police and their cameras, if they dont keep the camera completely still it can add 10mph+ to the actual speed.

But either way you were speeding but it might be worth arguing you wernt going as fast as they say..

^^ same as that i saw a video on youtube where a handheld device showed a WALL doing 8 mph!!!

Don't think you have a leg to stand on tbh, take the points etc and be done with it.

How exactly can you prove where you started off your journey? You can't because its a still image. No case.

What exactly will a rolling road graph with the top speed of a 16v polo show the police? PLEASEEE!!! Absolutely nothing is what!

I did yes and it was nowhere near 70 at the point they are saying. And my speedo over reads by 5mph so even if i hit 70 on the speedo i would still be doing 5mph under what they are saying.

Put it this way...I was speeding, but I wasn't doing 70mph!

Nop just trying to help you out if he did not use the gun right that book tells you what to say if i goes court ect am only trying to help but you want to be funny about other members thats up to you.

But you were asking how fast i was actually going. If I say I was doing X-mph and the police for some reason come on and see that, then they may charge me for that instead if I somehow win this case against the 70mph which I wasn't doing.

How can you prove you started 150 yards away from the camera??

For how much it is going to cost you in proving that your speed was 5mph less than stated is it really worth?

Potentially going to court over 5mph. I reckon it wont even be looked at, and for starters will it even make a difference 65 in a 40 or 70 in a 40?

Could mean my licence, I might not get the standard 3 points and £60 fine as a report has been put to the procurator fiscal. I'm already on 7 points and still got a year to go with them, so any more than 4 points and I'm nakered!!

IIRC a friend of mine got 5 points for 60+ in a 40 and roughly 170 pound fine.

I think 63 mph rang a bell.

I'm 99% sure you're going to wave bye bye to your license. They have taken a photo of you doing a speed which is wholly excessive for the posted speed limit. You can't really argue with their evidence...well you can try...but I don't think it'll do much good.

Given that you've already got points I don't think they'll look to be lenient...your young as well which again won't help. 64mph I think it was Ross, you're right with the number of points and the fine. Luckily he had a clean licence which was in his favour. Anything over a certain speed and you don't get the standard 3 points + £60 fine....even if you did manage to prove you were only going 60mph you'd still be looking at the same charge. If you go to court be prepared for them to rip you a new arse hole...they won't be impressed if you waste their time with a rubbish excuse and may just pick a particularly harsh punishment.

What I want to know is how can you get caught speeding if a camera van is only 150 yards away....are you retarded? If you have 7 points already you should be driving like a granny, I think it's time you took a break from driving for a while.

The camera, with the van hidden in a back road off the road i was on, was 278 metres away (I think if I'm reading the info on the picture right). I only drove 150 yards before they took the picture.

Why does everyone think I was doing 60?

I did see them but after speeding up then cruising at 40 past them and they were hiding in a bus stop, sun glaring and they had no high viz jackets on.

So you were doing 40? Not guilty then and go to court...you'd have to be sure you can prove that they didn't capture the speed correctly though...

I doubt saying you only just drove off at a certain distance away would work as you'd need to prove it.

40 there or there abouts at the point i was at. You can still see the traffic lights in the photo at which i did my standing start.

They probably pointed at my car due to me going away from the lights quite enthusiasticly(sp) therefore making a fair bit of noise.

To cut a long story short here you were speeding, if the police offer you points and a fine take them.

Even if you were doing 60mph I am pretty sure you would be looking at the same sort of penalty, also bear in mind this sort of offence would go to a magistrates court - they would take a dim view of your defence and proberbly see this as a waste of thier time resulting in more points and a hefty fine.

Unless you can afford a proper motoring lawyer I feel you would be ill advised to fight this one.

Please bear in mind I have no formal legal qualifications and can only advise from passed experiences of myself and my associates.

I've watched enough police camera action, etc. They cant take a reading of a wheel it has to be a fixed flat piece of body work and held for 3/4seconds. I'm sure of it.
