Go and get some legal advice if you want to challenge this. Posting up on a forum full of Polo geeks isn't going to get you the sound legal advice you need.

You need actual legal advice, speak to citizens advice and seek legal aid.

It is possibe that you could keep your liscence whilst exceeding 12 points wherby you must have a liscence to work ect.

Personally I think you should hand your lisence over.

Deserve what you get tbh, 70 in a 40 zone isn't the safest thing to do!

my dad did this 66 in a 40 and took it to court

the gudge all but said he agreed with him but gave him the 3 oints and fine anyway

just take the points it can only get worse from the point you are at now ie more points bigger fine

^^^ In my experaince thats correct, I've seen dozens of cases where people come to court and try to soften the blow of what ever it is their accused of and 9 times out of 10 it just makes things worse. As already said the best thing you can do is take it like a man and learn a valuable if painfull lesson !

i read that if you get the letter through the post that if u fill it in but dont singh you are name on it and send it off they cant do you cuz it cleary states in the law or what ever thats it ilegal to not fill the form in but not ilegal to singh it it was in a mag i read aprrently some guy forgot to singh it and got away with it! and its been let out ever since i duno if its true or not but id try it if i was you o n id be cuffed if my polo was going that fast off the line haha

I'm pritty sure that if it was done on the wheal it gives an inacurate reading therefore it is not a valid piece of evidence also u can ask them to produce the documents for the jobby sayin it has been calibrated it thay dont have it thn it also goes out of the window no matter if thay blatenly were going more thn 40 if it wassent calibrated or done incorectly then it doesnt count

dont mean to sound like a knob mate but speedings not very cool, your lucky you got a speeding ticket and not a prison sentence for ploughing a little kid over.

i think the whole 7 or whatever it is points on your license might be a sign saying "you shouldnt be allowed to drive"

the offence is excess 40mph regardless of the speed recorded, you have already admitted it by doing so on a public forum!?

To be honest mate there's not a lot you can do. There's plenty of websites full of myths about how to challenge speeding fines etc but most of them are nonsense and the court won't give them the time of day.

The chances of you getting legal aid to fight it are minimal since the offence is clear cut. Specialist "loophole" lawyers start at around £10,000 a time and even if you try and fight it yourself or manage to get some legal aid there is a very high chance you will have to pay the cost of an appeal hearing if you are unsuccessful (which you almost certainly will be) and that is also likely to be around the £10k mark. Not worth it.

Bottom line is your best chance is to take the points and fine and if this means losing your licence you could make the case that you need your car for work (get letters from employers, clients etc) and then you might get away with it but for 70 in a 40 you'll probably just get the book thrown at you

check this website out, i too was in a similar situation apparently 80 in a 40 when i know i wasnt going 80, the cameras that they use are very very gay and a number of things can give the wrong reading.

what i done though was own up and take it ...there was not enough proof for me to stand up against it and this softened the outcome i left with 28day ban and £150 fine and sp30 written on my licence (which is nothing), which is pretty good. i said i needed the car for everyday use to uni and i need it to work etc and that i would get fired if i get anything on my licence.... insurance didnt even care about the sp30 tbh.

if you have proof etc fight it, by all means but do it with legal advice. if not then dont try to half fight it because if you argue u will be seen as arrogant and they will just say "40+ but under 80mph is still speeding".

Speed cameras of any types have to be serviced or calibrated each year and if the police are caught using defective equipment then there liable themselves if caught.

Not 100% true. While it is true that speed cameras have to recalibrated (usually every 35 days, but not always) it is extremely difficult for a driver to prove this at court without forking out several thousand pounds for a specialist lawyer.

Plus there's the fact that police speed cameras are checked and recalibrated at least once a week, far more regularly than they need to be. In any case you'd be hard pushed to convince a court that you were really travelling at 40 when you were going at 70 and that the difference is due to a dodgy speed gun!

I wasn't speeding to be cool, I was on an empty road in the car by myself, I wasn't trying to impress someone...after all I drive a Polo. Even though it was in a 40 zone I felt at the time it was safe enough to do that speed (waits for hundreds of nasty replys to that) but after all, every day people do 70-80mph on motorways feet away from each other, I did it with no one remotely near me.

Anyway all this shit is over now, I've been to court and got given 4 points and a £400 fine.

And if there is any nasty replys to my points I'll tell you all now to go forth and multiply because I have learnt my lesson and paid the price.

I'm not here to argue mate, neither am i here to judge, all I'm saying is it takes a split second for someone to pull out, walk out or anything and at that speed you couldve easily killed someone or yourself.

everyone does 70 to 80 but thats in a 70 zone, not a 40.
