Hello all help needed with Car Tax.

Basically going to purchase a Polo this weekend its at a garage & its Mot'd but is still taxed but hasnt got a tax disk as its been sent back for a refund by the previous owner.

I have checked with the DVLA and is still taxed so really in theory should be taxed till end of the month,as you only get the full months back when you get your refund from the DVLA.

Even though theres no disk do you think it will be safe to drive home ???

I will have insurance & mot & car will be taxed but with no disk ??????

Any advice will be appreciated

Technically speaking, it's an offence not to display a tax disc, even if the vehicle has been taxed.

However the chances of you being caught and prosecuted are almost zero since the police simply refer tax disc prosecution to the DVLA. The DVLA would check their records, see that the vehicle is taxed, and that would be the end of it.

That said if the old disc has been sent back for a refund, then as soon as that is done then the vehicle would be without tax (unless you had re-taxed it) so strictly speaking you shouldn't drive it.

I'm guessing that the DVLA will know when the new owner (you) purchased the car. So if the old owner is surrendering his tax disc, it will be expected that you purchase a new one straight away. You can tax with just the new keeper supplement. It is highly unlikely you would get caught but if you did they would want to know why you didnt purchase tax on or just after the date of purchase. As technically the old owner is delcaring the car untaxed by sending his disc back. Its all very complicated. You can risk it but if you get caught there would be no defence in court.

Thats correct, there would be no defence in court but in most cases you would be made to pay the amount of tax that was outstanding since you bought the car and that should only be a day or so. I'm thinking of buying a car from the auction and as long as the car is has a MOT and is insured I'll just drive it home and hope there's no problems but I think if you were involved in a accident it could get a bit difficult !

Be on the safe side, goto the post office and get the tax disc there and then... drive it home... simple as

Imagine the hassle if u got stopped!

depends on the distance youve got to drive it home, I've only been stopped once by a police car in my entire time driving, and thats coz the copper thought my can of relentless was alcohol!

and when i bought my first car, i got the person to drive it to my house SORN, because it was about a mile away... personally, id risk it over a familiar route, but if i was coming from more than 15 miles away, wouldn't dare risk it...

you have to consider it as though you basically havnt got tax, because you havnt got a disk showing.
