Without a shadow of a doubt you would be at fault, not least for overtaking at excessive speed which would be classed as dangerous driving. There's no way you could ever defend driving in excess of 100mph, especially where it is a contributory factor in an accident.

In addition any part of your vehicle was over the dividing line down the middle of the road at the time of the collision any investigation would assume that you were at fault.

If you were speeding by that kind of excess, you'd waver your right to play 'victim' and despite the other cars lack of attention, it would be you that would get done, if you survived a 100mph+ crash that is..

I was abit, lucky there was room to overtake him when he pulled out.

Still, i managed to figure knowone was coming the other way for more then a mile, overtake 5-6 cars before he randomly jumped out - What was he doing the whole time before then? Picking his nose? ffs.

But, if i had gone into the back of them what would have happened to do with insurance, police etc??

It'd have utterly been your fault, though chances are, it'd be pretty much imaterial to you as you'd be in a smalll ball of metal, probably with a face full of your engine, so assuming it was still inside your skull, you'd have more pressing issues on your mind.

The average driver is expectted to anticipate what other drivers could reasonably be expectted to do. Coming up on him doing a 5 car and a wagon overtake at 110 isn't reasonable under normal circumstances, and would be at the very least questionable on blues and twos.

Simply because if something did happen it would likely have been the stupidity of another driver, but in this case you were more stupid in the first place to do what you were doing... I would have understodd the reason for it if they were doing like 40 in a 60 but you said they were doing like 60mph and 50 for a lorry is about normal anyway

I'm going to stick my oar in here, I think you were both in the wrong and it would have come down to who was more wrong. (worst english in the world I know) Your wrong doing was obviously blasting at a speed nearly double the limit, although they feel quite stable doing that speed dont they?

Equally the other driver was in the wrong for not seeing you or if he did misjudging the speed you were doing. However ultimately I think it would have been you that got pinned to the wall and gone over without lube I don't think the other guy was totally blame free.

Kerrly, I'm gonna stand up for you here and say out of the 2 cars the dude who pulled out on you is at 'fault' so to speak. Doing 100mph+ on a 60mph road is illegal and dangerous but if your anything like me, when you over take people you just want to keep on accelerating. As long as you slow down to the speed limit afterwards in a safe manner.

But anyway if a car is doing 50-60mph behind a truck surely just a quick gance in the wing mirror on a straight road you would notice a car comming up the outside of you doing double your speed. So it sounds to me that he didnt look in the mirror and just pulled out thinking he is the one directly behind the truck and everyone will just follow him out.

Speed doesnt kill - the abuse of speed kills. And in this case,speed was well and truly rogered both ends.

Neither driver was handling their speed in the required manner for the situation. But one was creating an additional hazard that the other,it could be said in court,shouldn't have reasonably been expected to look out for.

lol, i must have had a diesel box i think - i could hit 70+ pretty easily. It had about 170 brake, so it got there very quick aswell.

Mine just has a K&N panel filter 150.3bhp 2 weeks ago though at Storm Developments.

I think this is what is called "driving experience"......... only age will make you drive with other people's actions in mind & value your own safety more....sounds like a harsh & big headed statement, but as an old (er) fart on here mistakes can be made in seconds and cost you heavily for years!!!

I bet faced with the same situation again you might deal with it differently.

Yes very fair points, to but things in perspective the road is over a mile long in a straight with no dips or junctions so its very easy to overtake lots of cars.

If i felt i had to overtake the lot id have been tempted to go on the otherside of the road completely if the road was as clear as you say just in case the above happend.
