Hi all,

My mate Mitch was caught speeding last night at 23:55.

The road used to be a national limit, but in the last couple of weeks it's became a 50.

Now.... here's the bit i'm unsure of. The police officer was parked in a petrol station and clocked my mate as he drove into the national limit section from the new 50 section.

I'm pretty sure that police officers are not allowed in petrol stations, due to health and safety issues.

He was also obscured from view by the petrol pumps.

Any info would be great

what I've heard is they have to be seen from a distance, and camera/mobile camera signs have to be on the road but check that on the DVLA or something

They always try to hide, I would check the law, not ask a bunch of people on a forum that *think* they know. Get proof from some legislation, then rub thier nose in it..

The law is a simple on don't drive faster than the posted limit. When using a mobile speed gun there are no requiremnts for camera signs and no visibility requirments (there are no visibility requirments for cameras unless they are part of the scheam that allow local councils to take the cash generated).

The fact the police where in a petrol station is irrelevant. I'm a cop and in the last month I've caught 2 disqualified drivers on petrol station forecourts which went without a hitch :)

Your friend is unlucky with the change in the speed limit I'll admit but from a legal perspective there's nothing wrong with the manner in which he was caught.

It is irrelevant as to whether the police officer is visible or not, or holding a speed gun or not. They usually won't charge you with points/fine if they don't have a record of your speed, however, the fact that your mate was speeding and caught by a "hidden" police officer doesn't count for anything, he was still speeding.

I was caught by a traffic cop hiding down a side street which as you come down the road, a building obscures where he was from my position, but he could see me. Only got a warning as it was first offence and everything was "legit" and of course everything is declared.......lol

iv heard (but dont quote me) theres a six week or so, coud be more, period after a speed limit is changed before they can start to give fines, as for hidden it doesnt matter anymore even speed camera's are hidden in some places now, as long as there are signs telling you cameras or used in the area its perfectly legal.

As far as i can see though, it is just a guideline and not actually a law that they cant be hidden!

so not sure whether you can use it against the allegation :S

to be fair- you do the crime you do the time.

i can talk, i got caught speeding, and got a fine and points. end of.

it does my head in when people get of a speeding because of a technicality. you either are speeding... or your not.

You don't have to be pulled over. The police have 14 days to serve a NIP (notice of intended prosecution) on the registered keeper of the vehicle (note: they have to serve it within 14 days, even if you receive it after 14 days).

For some other motoring offences, such as ones that lead you to lose your licence (e.g. doing 100+, getting 3 points when you already have 9 etc) then you will be reported for summons i.e. straight to court without the option of paying a fine, in this case the police have 6 months in which to bring a prosecution against you.
