It depends what if anything is found to be unsafe. Some vehicle defects get 3 points (e.g. bald tyre) whereas some get none and just get told to repair (e.g. brake light out). In more extreme cases where a vehicle is deemed to be in dangerous condition you could get more points and a ban although this is very rare. Technically someone could be guilty of dangerous driving by driving a vehicle in really bad condition but I highly doubt that applies to you.

I dont get it though, they have the power to take the car off the road for pretty much any reason they see fit, and make you get it MOT'd, and if it passes all is ok.

But, loads of people have said an MOT means nothing in the eyes of the law and they can override it if they want..

It's not quite like that. While the police can inspect any vehicle they want, they would still have to find some MOT-failing defects on it to make you get it re-MOT'd. The only example I can think of from work is a taxi that showed as having an MOT but was clearly falling apart. It was seized and inspected and 44 different defects were found so in that case an MOT meant nothing. It turned out the taxi firm only owned one roadworthy vehicle which they used to swap plates with all the other vehicles in their fleet when it came to MOT time.

Its mental what has happened, and as long as your insured properly and moted properly you should be fine- certainly in the regard of suspension.

As for tyres and plates... if indeed they are illegal it does kind of undermine your defense- it might not be as simple as just taking those on the chin and then arguing the rest.

I appreciate its easy to say- il just take the fine for a plate.. but its not a great idea. If i was a copper, see a car without a number plate, straight away I'm thinking 'ello ello ello, something is up here'.

Il give you an example- saw something on tv a while ago, some kid in a civic type r. Police following him, ran his plates and they came up as not belonging to the car.

For all they new the car was stolen. Maybe he was dangerous. What would he do to get away/not be arrested.

They went in hard, took him off the road and wrestled him out the car.

Turns out 1) the guy was a complete dick, and 2) honda had messed up his registration when he bought the car, he couldnt be bothered/hadnt got around to picking the correct plates up, and he had infact already been pulled for it previously, and was still running around with the wrong plates.

Innocent enough, but on another day he would of been someone rolling in a stolen car with fake plates and a gun in the glove box.

Not sure if this has made my point... but if police see you doing something blatently wrong... they are going to asume the worst. Any copper who doesnt asume the worst these days is gonna end up stabbed or something.

as for the plate in the window aspect of this...I've got mine in the window until i decide what to do with the front bumper, as the recess has been smoothed off. because i was paranoid about this, i spoke to the local super intendant about it (friends in high places) and basically he told me, that its not illegal as such but is frowned upon.

basically if I'm running the plate in the window it could be that it dropped off, so better to place it in the window than not at all, he did however say that if I'm seen at a later date by the same officer then i may get in trouble for it but he couldnt be sure of the punishment due to the grey area of it :-s

i agree with seanvw near me there are a few cars with number plates in windom not just vw's but rx7's and supra's and as far as i have heard its not illegal the police just dont like it as its harder to see in rea view if in front but i still dont actually see how they can deem your car unsafe the copper just sounds like a total bellend to be honest and he is just trying to make an example of you to scare people into been different with there cars but i am affraid he has dropped a bollock and its his own fault hope you do get it sorted m8 i know how hard it is to not have your car i got banned for 12 months its a real ball ache especially if you need it to geet to work and stuff really feel for you man

right alot of stuf has happened since i last posted on this thread

last night after leaving the policeman several messages, it got to 8 oclcock & i acceped i wasnt going to hear from anyone till the morning

this morning while i was at work, my mum started on the phones at 10:30, a reasonable time to give the police a chance to sort things out & maybe call us

after being put on hold, leaving several messages we were finally told the officer who was going to give us the result had actualy gone off duty at 11..... untill FRIDAY!!!!!

so i was at work waiting for results

the cop shop said they would get back to her when they find out

she chased & chased for me, phoning 24/7 who couldnt tell me anything

it wasnt untill 3 oclock she was put through to the CUNTstable who finally gave her the result

[fuck knows why it took them from 4pm yesturday to tell me!]

but yerr, as mentioned above some of you might have noticed I'm after some new wheels

which concludes my car didnt pass

they cant purtrude past the arches what so ever

so i was told i can collect my car before 3pm tomoro

but I'm not even back from work at that time!

so my boss who is safe as fuck took it apon himslef to make sure i get it back before i incure any impound charges!

the place closes at 5 & it was half 3, so we rushed home, grabbed his 4x4 shogun & after many frantic calls my mates dad had a trailor we could use!

fuck paying for another flatbed or trailor!

so i managed to get it home free thanks to people i know

so here i am now, car on the drive, £150 down for the release fee, no paper work so i dont know what i have to change or when i can drive it, i dont know if there going to prosocute so i dont know if theres any further fines, points or anything

only paper work i have is from 24/7 saying iv payed to get it out

they told me up there it was my wheels were poking out, but its not clarified without the paper work

so iv given up, the police are utter wankers & my mum bless her has had to do all the chasing! my parents & myself have lost all faith in the police force, it seems so unprofesional & corrupt

so my easy option is to jsut get new wheels, put the plates on & just be gutted to no end

i feel even with all the paper work & documents its too late to even make a change

its been the worse few days since iv started driving, i dont want to have to go through it all over again

the hassle for myself, family, my girlfriend, my work, friends has been too much for me to even care about the car anymore

why bother?

I'm still greatful for everyones help & support but the police are way too stubbon & havnt got a leg to stand on, they jsut wont accept there at fault in any aspect what so ever

so iv decided does anybody want to buy my wheels? or consider a swap for some lower offset ones?

If this happened to me, I'd have been at the police station everyday pissing them off until I got my car back and then after legal advice hitting them with more shit to why they have done this is not the correct manner or following correct procedures - Doesn't matter if they're the police or not

shame to hear bout this sounds like the copper have been very unproffesional and reading this certainly knocks my confidence i the police. You don't really need to sell the car i have just been looking at pics of your car and i reckon if you havd the backs of the wheels machined off like 5mm or soething (alot of places do this) and then got some camver shims you could be onto a winner as they dont stick out that much really i have definitely seen worse so you have been very unlucky with this. with a combination of milling them camber and arches pulled slighly you should be fine, isn't your a unlce a a bodyshop guy??

its a pain that for sure. and a disgrace.

My advice would be not to over react and sell the car etc etc, just get a set of standard steelies, and run on them until you get some hard evidence- i.e. paperwork, off the police saying:

1) why car was impounded

2) what tests where carried out

3) what the car failed on

Might seem like a lot of hassle and it probably is, but such a shame to just get rid of the car, not to mention you being out of pocket.

I just hope the rest of you listen to this because you never know if there clamping down on this thing I'm sure most of us knew the tread could not past the wheel arches plus iv never been a fan on stretch tyres anyway so it doesnt concern me but i fill sorry for you i mean i had my car impounded just having the car up on the kerb yet i know i couldnt do it in and around croydon i just fogot my mistake cost me £250 utter wankers.

I just hope non of this happens to you guys be a real shame there are some nice cars with stretch tyres on so please everyone be careful

I thought they impounded your car due to the suspension being too stiff? Now they are saying the car is unsafe due to the wheels sticking out of the arches too much? And you have no official police paperwork saying that your car was deemed unsafe by them?

Sounds to me they have just taken you for a ride and made everything so bland they have an excuse to pull you some more to check up on you.

If I were you though just get a hold of some less wide wheels but keep the ones you have just now if you can and just run them for shows and stuff. That way 99% of the time you will be running legal and shouldnt have to worry about getting your car taken away again.

you should have been quoted distance "X" protruding from wheel arch at bare minimum, and obviously a sniffness reading on you suspension.

vosa would have been tasked to test these if there is such test for suspension, and I'm quite sure there would have been a fee involved payable by yourself.

get back down the cop shop, ask which vosa unit and examiner saw the vehicle, where your copy of the test documentaion is.

Surely you'll have to of broken some sort of rule or regulation for them to deem that your wheels potrudes to much, not just their opinion? I know you're feeling down about it but don't just fold because then you've let this traffic facist get his way, seriously step-up mate your car looks sick..
