Got pulled over the other week because of the section 59 I've got and apperently i was driving with out due care and attention..

Had my car seized and had to pay 150 to get it back..

He also gave me my rights and said i had to go to court and if i fought it, then i would get 3 points and a fine + maybe more. The copper said i could just plead guilty and just get 3 points & a small fine on the other had.

The incident happened two weeks this sunday coming and nothing has yet come through?.. Now i heard that if nothing comes through after two weeks of the incident then i cannot be taken to caught etc etc?

Can anyone shed some light on this? Would be much appreciated :)

Because you were pulled over and read your rights the two week rule no longer applies. They now have up to 6 months to send you an N.I.P. (Notice of intended prosecution).

I'd say within two months you'll get a court date which will be a month after the date of the letter...if they are going to charge you.

but I've spoke to a few other people and they have said that its just his word against mine and he has no evidence..

And it costs a hell of a lot to take me to court for them so basically that they might not try me because theres no evidence etc etc..

No, they've already given you a verbal notice of intended prosecution (as you put it in the americanism - they've read you your rights).

Just suck it up and take the 3 points. Although I've never heard of anyone getting 3 points after getting charged with a section 3 offence (careless driving), they usually get at least 6.

I've waited to go to court for 8months before dude!!

Think I got away with it then the next minute I have a letter through the door! :retard:

I was 2 weeks off 6 months when mine came through.
