Just been sortin out the garage and drive havin a good clear out, and i moved my polo which is currently uninsured onto the pavement/road outside the house. My Dad came home, and being a copper he started having a rant at me and telling me how illegal i was being and that it was an endorsible offence..

He said that if it got crashed into by someone else on the road then i would get done because it's not insured. Now.. ignoring the fact that i illegally moved the car onto the road in the first place, how can it be illegal to leave your car on the road when it's not insured and not being driven? i mean, for some people who live in terraces and have no driveway or garage, what are they supposed to do if they run out of insurance or whatever? and if someone else crashed into it and it was their fault and my car wasn't actually being driven, surely it makes no difference if i have insurance or not, as it is on them?

I'm not having a pop at the law and trying to act above it, i'm just a bit miffed as to how this works if you physically have no other place to keep an uninsured car other than on the roadside..

i thought it was just with no tax is illegal but then again if u have no where to park where can u put it???

It's the law, if it's parked on a public highway it should be taxed and insured. What happens if the handbrake snaps and it crashed into a young man with a family, killing him. The claim against you could be pretty chuffing high. Plus if you get caught you get points for driving without insurance, then you probably won't get insurance again for less than eleventy-billion-trillion quid!

Its just not worth the hassle mate, either park it off the road at a mate's family members house, scrap it, or get it made legit pronto before your old man nicks you!

My breadys parked on a grassverge outside my house with no tax or test. Its pretty obvious it dont get used currently as the grass has grown upto the wing mirrors!

Anyway, i cannot put it on my property as between my front garden and the grass verge is a 8m deep dyke and only a footbridge to walk across. I refuse to spend money to tax/insure a car which i cant use (it dont start and the handbrakes seized on!) If someone hits it, its through their own dangerous driving and not that fact my cars parked a good 1.5ft from the carriageway

How did it get there in the first place?

fact is, if you dont have it on private property then it is on public space and therefore has to be taxed, mot'd and insured.

If its on the road it has to be road legal, whether its being driven or not.

My question has always been, how can you get charged for 'driving without insurance' if your car is just parked on the road with no insurance?

Because surely if there is no evidence of you actually driving the car in that state then they can't charge you.

It was road legal when I parked it there but have since run out!

You don't have to "drive" with no insurance to commit the offence, the offence is to "use" (or "cause to be used") a motor vehicle without insurance. In a legal sense "use" has a very wide meaning and includes just having the vehicle parked up on the road.

In other words, if your car is on the road it MUST be insured or you risk getting 6 points on your licence and getting a massive premium hike on your insurance.

But mines not on the road but a grass verge. Quite afew houses on my road have no driveway due to the dyke so use the verge which is mud/grass as their primary parking.

It's unlikely anything would come of it, but if your vehicle is on public property (even if it's a grass verge) then technically it ought to be insured.

That means (as far as I can interpret) that because you are not allowed to keep it on the roadside, you have to arrange for a tow to move the vehicle to a suitable privately owned parking place like a mate's drive or something because it is no longer allowed to be driven, and it can't stay where it is.

I can see the reason why a car must have insurance as explained by M4TTY for third party injuries to people and personal compensation such.. but my car is not on a slope so the handbrake breaking will not cause it to move (it's also left in gear), so there is no way it is going to move and maim anyone of it's own accord - it's fine where it is!

If I parked it on my very steeply sloped driveway to keep it 'legal' and then the handbrake snapped and killed some dude.. what would the case be then? I parked it legally on my drive, and I wasn't driving the car when it rolled off my drive and knocked 'this guy' over but now apparently you can get done for 'driving without insurance' even when you are not in the car so who's to say I wouldn't get blamed for that?

That may be case. Maybe its a government attempt to stop people having crappy old cars dumpedparked on the road outside of their houses.

Was just an example of a potential, but somewhat unlikely scenario. If it was parked on your property then your house insurance may cover it. The law is the law, its like saying it wasn't rape it was just a suprise!
