is there any way if someone was given 3 points and £60 fine to dodge the points? an old friend said about a rumour that if u send a cheque away for £61 instead of sixty and then they give u a cheque of £1 back and u dont cash it, app it voids the points?? we where in a bar at this stage so the alcohol cuda been talking? but has anyone heard of this being done in NI or mainland UK??

Sending £61 does work in the fact the points won't go onto your licence until they have paid you back the £1 extra you sent. However you cannot just recieve a £1 cheque from them and not pay it in. i think its pritty shit that the option of the speeding course isn't available to all the areas tho, yes you shouldn't speed in the first place but if they offer the option to dodge the points to some then it should be a option for al, it shouldn't be a post code lottery imo.

Yes, asking for a picture of your car is one where they will provide you the picture if you go to court. They basically do it because they know 99% of people are guilty and won't go to court with it because they know they will lose.

just outta interest dude, how much did you are insurance go up by with 3 points on the valver? i think i may have been done the other day by a cop hiding down some little side road with a gun, just gotta play the 14day waiting game now i guess. was wondering though, with a radar gun, can they be sitting in their car and use it or do they have to be outside the car holding it? possibly a dumb question

There are many myths surrounding avoiding points, here's 2 i can recall off the top of my head:

1. The one you pointed out was the classic trick which was the sending £1 extra and not cashing the check. Now this used to work because in theory, it was a loophole in the system, how could they administer the points if they did not follow their own rules? They can only administer points in accordance with receiving the £60 fine and no more.

However, legislation covered this when it was apparently abused and so perverting the course of justice covers it and a much heavier fine and possibly jail sentence can occur from doing this.

The second is one of the most obvious. Get someone else to take the points. However, this is a very complex matter as you need proof. You firstly have to have not been identified at the time of the speeding offence. For example, if it was a rear shot of the car, you may just be lucky enough to not have been in the image, also, rear window tints help with this.

Therefore, it could be possible to say someone else was driving. However, they will therefore either have to be a named driver on the insurance, or will have to be covered by comprehensive insurance and allowed to drive another persons car where they are covered under third party insurance.

To be honest, a right royal pain in the arse to justify so there's no point in this, and if found out, you will be knee deep in it.

There are ways to avoid getting fines and points if you are caught by a speed camera or even pulled over by a traffic officer. I will list these here:

Firstly, you can question the calibration certificate of either the speed camera, or the hand held device that the officer is holding or his on board camera. The roadside speed cameras will have a set date between which they need to be re-calibrated. The hand held and on board speed cameras need to be calibrated every 24 hour period. I'm pretty sure this runs from midnight to midnight. So if you're ever pulled just after midnight, always question calibration of the equipment.

Secondly, you can question the legality of an officers car. If they have a bulb out, on the car, they shouldn't be on the road as their car is un-roadworthy and if they have an un-roadworthy car, they shouldn't be on the road to pull you.

You can also question if they have registered their tyre tread depth before they started their shift. If they have not done so, they are not allowed to run the vehicle on the road for that day. So you cannot be pulled by this car.

Finally, if the worse comes to worse, and you do have a backlog of points that you wish not to add to. You can ask to exercise your right to view the act of P.A.C.E.

This is a large book in which police officers don't usually carry in car. Therefore they have to go through the effort of radioing through for another officer to come out and deliver the document to you. You can then sit there and read every single word of the rather huge document. Obviously, there are probably restrictions on you taking the biscuit on reading time, however, a lot of officers I can imagine won't want the hassle of waiting.

Note: This is all based off information I have picked up from Traffic Officers, Friends who work of have worked in the Traffic enforcement agency etc etc. Also note that if you do decide to take the biscuit and attempt any of the things I have stated, I'm not held responsible if you get bent over and swiftly taken up the rear for more offences that simply speeding for wasting more time. :)

As people have said, asking for the calibiration cert can be an option, on the off chance equipment hasnt been calabirated. Apparently this is more likely with hand held devices, but who knows. I did it when i was caught a while back, and i got a nice photo! Unfortuntaley i got the calibiration cert too

As regards it being a lottery, i'm sure its more down to how fast you were going at the time, and whether it was a certain amount over the limit. Although the centres arent everywhere for the courses, i'm pretty sure you get the option if you fit the speeding criteria and its your first offence

Nah, can be in the car. Though your less likely to be caught this way, since it relies on the cop thinking that you are going faster than the limit, and then preping the gun etc. So unlss its really obvious, your unlikely to get done. Was it head on/from behind? I'm not sure the guns work from a perpindicular angle

i've got a mate that has taken points for people about 4 or 5 times now i think, they just give him a gram or 2 of coke and pay his fine... he's never even had a license
