Ok guys coming home from work i had to brake suddenly as the car infront of me stopped, I stopped with sufficient distance infront of mean, came to a standstill then..... Bang! A lady driver drove into my rear! (my rear balance is dented to hell n my upper section is scratched! The ladys megane is only superficial damage) but she insisted on going thru insurance! Saying it was my fault I stopped suddenly and I had a near side brake light out (checked this morning it was ok!?!) she had been behind me for about 3 miles! I have notified insurance etc and I'm just playin the waiting game, I think I'm alright legal wise! Just bizarre she insisted on insurance!

Just to warn you (I'm not saying it was) your light could have been out and just had a loose connection, sometimes it doesnt work, you give the light a nudge and it works. Still no excuse for the woman driver that went into you though

I always carry a fullset of replacement bulbs in with the few tools I carry, so I have replaced the bulb it was actually blown, sensibly i checked it this morning because I've not been out in it for 5day due to swine flu! It just shocks me that she thinks it's my fault!

Thats gutting man. As they say, anyone goes into the back of you its always their fault (if you dont spin out or anything). Just unlucky to be honest, it happens to everyone sometime, got to look at the good point that she wants to go through the insurance unlike when someone went into the back of me and claimed he didnt touch me and nothing happend about it.

in all seriousness though, you may have had a loose connection. but, she was behind you and should of been driving within sufficient distance to stop. if she was driving so obliviously to drive into the back of you, how does she know for fact your brake light was out?

you drive a mk4 so I'm guessing you also have a rear window brake light + one more - shes just trying to weasel out of it no doubt.

your in a win win here mate, infact if i was you i would hand the case over to a third party specialist company. You will get a hire car and car repaired, and her insurance will foot the bill for it all.

Basically she went into the back of you and is trying to fob it off that one of your bulbs was out. Unless she has an independant witness to back her up, they she hasnt got a leg to stand on.

Its one of the laws of the universe- you go in the back of someone and its your fault- pretty much all of the time!

she had her friend in who took pictures of the car with one break light out and the "damage" (she was looking at me tutting her head while taking pictures so i just bad man stared her out hahaha) they were really rude towards me actually, i got out of the car to say is everyone ok n to see if anybody was hurt, n they just went on about it being my fault! hahaha

i have a courtesy car included in my insurance, just need my car writng off to get it (either a 1.6 focus/golf)

i also have excess insurance so i dont pay shit lol, the best £32 every spent when my excess is £800

should i push for repairs or should i get the car written off n then buy it back for pence and repair it, then spend the rest on parts??

End the day mate she didn't leave sufficient braking distance and so its her fault no matter what. she can try and blag the brake light being out but it wont work.

just been told my poor car is unroad worthy due to sharp edges on the rear valance so there sorting me out with a 2.0 gttdi golf!

ok so the 3rd party admitted liability on the 3rd i have found out after chasing up my insurance company! lol 7 days ago! y wasnt i informed on friday when i rang all i got told is we will be intouch with them to fiind out some more details and if the 3rd accept liability they will then organise to come inspect my car! what a bloody joke! they dint even realise they had accepted responsibility 5days prior to my call on friday! the clock is ticking for them to come out, inspect it, make a decision and pay me, then i gotta wait for my money to clear! then i have to sort a car out! (buying my car back and fixing it then sell it and combine my money to by another lol hopefully!) and to top it off my courtesy car runs out on friday! what should i do? try extend my time??

Had a similar thing with the van. They wanted the courtesy vehicle back the minute the cheque was issued (not cleared, or arrived, or posted, when it was issued), I told them to fuck off, they got arsey and passed it to the hire company.

The hire company told me they were coming to get it, I told them they'd have a job because I was working away. They asked where and I told them Stornoway, they could have it back when I got home. So they said there'd be an extra charge, I said fair play, ask the insurance for it. The insurance rang me back and said they'd charge me. I said good look, as I'd just cancelled my card.

I kept the van for another week and never had anything back apart from a few whingey phone calls. When I'd finished with it, they rang and went on a bender at me over still having it and said when am I going to give it back. I just told them when they grow some f***ing manners. A little later one of their managers rang me back in full arse kissing mode and I told them to come and get it.

Whatever it is, you'll need to take it thru a test equivement to an IVA (updated SVA) - was £250, but now hearing its going up to £500 a throw.

They'll run a full road worthness check before you will be able to insure and drive the car. I've heard stories of cars failing for oil leaks etc. which is another £500 notes for a retest.

Best way to make money out of the car if you have the space is to strip and sell the bits here or on eBay....

My dads mate repaired cat c write off got it VIC checked in Oldham like £40 n then it was all good!still drivin round town to this day I did it with my 1st Clio too when I was 16 bought a bent one sorted in etc! Don't cost that much does it?

LV man came out today was a real nice bloke had a cuppa with him n a chat etc, he said its more than likely gonna get written off but i get to keep the car no matter what?so I'm quids in tbh! I'm gonna buy another 6n then repair my poorly polo then flog the bugger!!! its a great car and i will be sorry to see it go as its ace but the one i have my eye on is a minter! then december here we come, insurnce with a company that isnt gay about mods and my project will be revealed!!! An SVA test is a form of MOT for kit cars etc that people want to use on road. There are different criteria to the MOT test.

well the 3rd party is now disputing quantum, (whatever that means) basically they dont wanna pay out (they are also aware that i have a curtesy car) but the 3rd party driver admitted liability ages ago! so any ways i have to get a proform quote to send my insurance then they forward it on to them and give them 28 days to pay or my insurance will take legal action!

why the hell should i do all the leg work?? thier driver was at fault not me! why the hell am i paying insurance anyways??? they haven't particularly done anything about it and dont seem to fussed tbh
