in my 3rd year of studying law now, and my spidey senses say you are entitled to everything you put into the car that was destroyed. even if you had no insurance yourself, it would be irrelevant in terms of mitigating their payment to you

i know the owners through my dad thats why my car was there and i wouldnt want to kick them while there down seeing as i know them..the landlord saiod they haven't gt contents insurance but i really cant afford to get 1900 quid for something iv put a year into and an extra 1800..the one owner has said there going to have to sort something out with me but they haven't elaborated.

do you want some one to take you for a pussy because they know you?? if you really wanted to you could get a higher car to use day to day and charge them for the pleasure. i think you need to have a word with them and tell them that you know what your entitled to, it might make them realise that they are lucky your not being an ass hole and going all out on them...

No contents insurance? wtf. what about public liability insurance? (you leave pick up your car after a brake change and end up in a tree a 100yds down there road as they failed to bleed the brakes they are liable for the repair work as they failed to ensure the car was safe to drive)

Id get on to citizens advice and see where you stand, any reputable garage covers themselves against damage caused to customers cars while in there possession (which yours was). If they were as stupid not to have contents insurance then they might try and fob you off with bugger all.

Mate don't let yourself get ass-raped. I recon they'll try to do anything they can to not give you the money by the sounds of things. As was said above get onto the citizens advice bureau, an make sure you get every penny back.

yeah man, try and get it sorted with them face to face first. after about a week it will be ridiculous if they haven't given you some confirmation of whats going on.

if you cant get an answer from them then ask your dad to, if he is mates with them or something.

if you get no luck within another week i would seriously look at taking legal action, and go to citizens advice bearau and ting.

is it possible that the business had no insurance, just like you can drive a car with no insurance?

finally, i would dig up all the receipts of everything you have ever spent on the car. then get a figure in your head of exactly what the car was worth with all the mods on and stuff. if things get heated, you are going to want the exact figure of what you have lost out because of this and be able to prove it, and don't change the figure.

if you got stuff off ebay, try trawling through ebay emails to find the seller you bought them off, then send them a message and ask if they can re-issue you and invoice by email. ebay sellers are like businesses and have to keep records for a long time, so if they are feeling helpful they can do that for you, so you can prove your cars value.

dont try and claim for stuff you didnt put on the car, as it probably wont stand and is just not cool

shit situation to be in though mate, i would cry like a child if this happened to my car. and being stuck without a car to drive is what i imagine being paralysed is like, hope it all gets sorted to your satisfaction dude.

The fact that you technically had no insurance shouldn't matter, you could have trailered your motor in.

i figured it out that iv spent about 1500 quid on the car

500 on the wheels including tyres (ebay)

200 angel eyes (venom)

200 coilovers(philj)

100 tints (got receipt)

smoothed boot 150 (done at that garage)

fog conversion 100 (parts off ebay and they fitted them)

leather seats 300(ebay)

then i had thigns like an custom exhaust 150, 150 quid system,40 quid bulbs, bonnet bra in the boot

that is the money i ahve put into the car an i reckon i can prove all of that so is that what i should look to get from them

after my insurance get back to me on what there doing, all see if there insurance covers it, if not then ill give them this bill, but it adds to 2 grand and i dont think they can pay that..

on the car scene i dont think i can get another polo ..maybe a bmw compact ..somethign that doesnt go thorugh gearboxes like the polo

i wouldn't say that is what you need to ask them for.

theres another thread kind of similar on here all about claiming off insurance as to how much your car is actually worth and stuff..

basically i think you claim for however much you think it would cost to get hold of another polo in exactly the same nick that yours was in before it got burnt (even if you dont plan on getting another polo). not sure how you would work it out to be honest, as it had the mods aswell.

and if you will be claiming on the garages insurance, i dont know whether they would give you trade price on the car, and then pay for the mods on top or something?

i would ask for the figure i paid for the car when i bought it, plus the cost of any modded parts i stuck on it (with receipt to prove) and some more for being thrown into that situation and needing to take public transport to work everyday and for the hastle of it all. and also for the hastle of having to go look for a new car.

if the garage doesn't have insurance, i don't know how you would do it.. but at the end of the day if they refuse to pay you a sum you are happy with then you can get legal on their ass for no insurance and you are pretty likely to win.

that's what i would be doing. i'd give him a couple of days to get his shit together, he'll have a lot going on now and not just your car to sort at a guess. if he hasn't got the correct insurance then you would have to take him to the small claims court i would of thought, hopefully that's not the way it goes though because it could take a while and if he has no insurance he will be liable for all the lose and damage to every ones property caused through the fire. that's gonna come to a shit load at a guess, which begs the question could he afford to pay that? if not then what happens then? bankruptcy maybe?

it will have nothing to do with his insurance though kam, it should be covered by the companies contents insurance just like every thing else that was damaged/destroyed in the fire. correct me if i'm wrong but it could have no insurance at all on it but it should still be covered by there insurance? just like workers tool boxes and shit that won't have there own insurance policy?

this is all going off the assumption they they have all the insurance that they should have, if not a lot of people will be loosing out on a lot of money because of the owner of the garages stupidity.

and as someone else said above, the car may have had all the mods put on and then been trailered to the garage.

it only needs insurance to drive out on the road doesn't it? once it's through them garage gates it's in the garage's domain and should be covered by their insurance until it leaves and is on the open road again.

that's as far as HIS insurance is concerned.

but so far, it's the garage's insurance who SHOULD be dealing with it. if it turns out that the garage doesn't have insurance, then the boss dude will have to fork out for something.. but will probably go bankrupt as according to the ad there were lots of top of the range cars in there aswell. 3K for a Polo will be the least of his worries.

then again, we may just be exaggerating. i'm sure he's got insurance and it will all be fine. it's still a totally shocking thing to happen as he has to start again with planning and organising a business, and now has now source of income, even if he does have insurance to cover the initial losses.

heatagram I'm not looking for 2000 quid because i know things depreciate and i wouldnt be able to sell that car for 4000 however i did have a few people offer me amounts of money for that car and i believe it was worth around 3300. and your the only person iv heard who thinks i shouldnt get paid out, its true that there insurance should cover my car, however the car is completely burnt out anyway and all the mods are now unrecognizeable, only the alloys are left ont here.. but my car went there in one way and is not going to be returned in the same form so they need to compensate

i will hopefully find out whats hapening tomorrow

by the way am i entitled to a courtesy car?

well the obvious answer i think is yes, you are entitled to one.

but that in no way means you will get one :(. to be fair, you were put in this shit situation by the other party.. so their insurance should make up for it. especially if you neeed a car for your everyday commute.

but it just depends on how the garage contents insurance works, i don't think it's like car insurance like if someone else crashed into you.

i suppose they could argue that your car was in the garage so you weren't going to be using it for a few days anyway.

Yes the insurance company will have insurance and no matter what the cost of the payout, there excess will remain at an equal. Thing is if they dont have the cover then they dont have the cover. If they are a ltd company then feel free to take them to court, otherwise it aint worth it as they wont have the funds.

I've graduated with a law degree a few years back and know that the law wont always side with the innocent.

iv spoken to the owner, and they deffo haven't got contents insurance, and my insurance is saying the claim is on hold because there hasnt been a report filed, as the police dont know if its arson or an electrical fault now,

the owner is saying that its looking like I'm going to have to get the insurance pay out and then there going to have to pay me out there own pockets, but saying this might take quite long, I'm going to want 1300 from them which i think is more then fair, as 3300 was the latest offer i had for the car,

and because the claim is on hold, no courtesy car yet for some reason, but more than insurance for some reason have there call centre in india

yeah he actually said to me it was 400 quid a month so we never took i out because we didnt think we needed too. i was so angry at that moment i was going to kick the shit out of him.. he is settin up nextdoor i think with 4 partners and is sayin he will pay as soon as. I'm going to phone my insurance and see whats hapening otherwise my cousin sister is a lawyer and is gonna ass rape him
