Basically my gf Was coming home from work the other day then all of a sudden a taxi's rear door swung open. There's no damage to her car but the taxi chap is saying there is dents in his door and needs a new door. Surely her car would be damaged aswell? Iam going to assess his damage to his door as he wants to charge her 65quid for a new door. But what Iam asking is who's at fault. Surely it would be the passenger opening the door into on coming traffic? As your obstructing the flow? Any help would be nice!

The person getting out should have checked it was clear and is at fault.

And that 1m rule isnt really possible on 90% of roads with out you crossing the white line, the person exiting the vehicle should look around BEFORE attempting to open the door. Your GF could have been on a bike and the same thing could have happened with a worse outcome.

Theres a few narrow streets round here were people just step out to enter the drivers side of the vehicle when your coming passed, and I'm sorry if this offends someone, but there arse is softer than the brick wall/railings on the other side.

I'd say to him sort out out through insurance and i bet you 99% you won't hear anything of it again!

Deary me, nothing worse than people preaching shite from the highway code. It's basically a book that tries to replace common sense! Yes, you should stay a doors width from parked cars... where possible.

I would say the taxi driver is trying to be forceful towards a woman because he knows full well it was his fault.

at the end of the day she should have waited for a clear time to overtake, also she should observed that a taxi had pulled over, and will mostly like be picking/dropping people off.

women driver, like heather mills she hasn't got a leg to stand on.

from my point of view here its clearly not her fault if someone opened a door into my car ide be looking recover the costs from them. and if you want to get technical the highway code works both ways

and to be honest its probably just a taxi driver being a bastard there not known for being the most honest people are they. tell him that your going to contact your insurance company about the issue as you feel the car needs checking for structural integrity bumper damage and that the light may need realigning that will probably cost a lot more than £65 at a dealers and I'm pretty sure he should back down.
