Hi, i was wondering if someone can help me.. i was on my way back from work and as i pulled into my road there was a line of traffic and looked down my road and someone was pulling my car onto a truck... so i ran down the road and started a fight with the geezer... and he goes hes been sent by the council and its a police matter.. and my car had road tax and mot.. the car has been sitting on bricks for the past week but i was going back to london next monday to get wheels which i have lying around in my garden.. the car was going to be scrapped in about 2 weeks... at the moment its being broken but the only things that are missing form it are the door cards and rear seats and the wheels.. They must of bought wheels with them and they put it onto the car and they gave me a reference number and name and they said to contact coventry city council.

They cant take my car can they? i mean i own it and its taxed and tested and was parked outside my house.. isn't that illegal?. as i didn't get any notice or anything before they took it.

i contacted the council today and they said that, that particular dept is closed on weekends and i have to contact them on monday and thats really pis**d me off, will they charge me to get my own car back?

If it was parked on the road outside you house, they can take the car. Its a public road and someone probably complained about it.

Most likely, they will charge you to get it back as it cost them for the recovery truck and storage.

If it was on private property and you can prove it, you may have a case in court, you may even recieve some compo.

by law you arnt alowd to park up in 1 place for any longer then 18 hours , this is a verrw lose law only brought into affect to move on travlers , also having no wheels would meen that the car is un road worthy and not ment to be on the road without a simlar tipe of permit to when you have a skip or building material outside your house, hope this helps

what happens if you go on holiday for a few weeks and leave your car parked up?

i know you said its a loose law, but it sounds like a bit of an odd law in the first place

by lose law i meen if some 1 wants to b a prick they can use it , but tbh most police dont bother or dont know

does it need to be insured to be parked on the road? surely it only need that if its being driven?

i would of thought you would need to pay to get it back as well mate, they are tossers like that. what car was it and was it worth much?

I very much doubt they could enforce this unless they employed two people to watch your car solid for 18 hours not taking their eyes off it once.

Without something like that who is to say that you didn't take it down the shops when no-one was looking then park it in exactly the same place again?

And at McLovin:

To have your car legally sitting on a public road it must have Tax, MOT and insurance. Sounds silly but if someone comes along and hits your car, your car rolls and hits another car then you will be liable to repair the car that yours hit. Even though its not your fault and no-one was driving.

when you put it like that it does make sense

they will charge you for the towing and storage, storage only gets charged mon to friday or saturday depending what days they are open (obviously they cant charge for sundays if they not open cuz you cant get your car back lol)

Also if the car aint worth much just tell them to keep it, then you dont have to pay anything

Surely they're required to give some notice before just randomnly taking the car? They guy states that no notice whatsoever was given.

it all sounds very very fishy to me.

If it was me and I caught anyone doing anything like that, there's no chance they'd get away with the car.

thanks for the replies guys.... it was a mk2 golf its not insured as i bought a polo a week back and transferred my insurance onto it. if i tell them to keep it will they charge me? the car was in the process of being broken but i had only sold the rear seats and door cards. its still roadworthy. I bet some dick low life complained about it to the council. but even if i do get it back free i would have to collect it from them and arrange insurance. its a private road that it was parked on so i don't see why they have the right to take it. I was thinking of going to the citizens advice bureau and seeing a no win no fee company. Because this could have been any car, any car that had its wheels taken off and sitting there for a week. The only way to find out whats going on is waiting till tomorrow and phoning the council. But if they ask me to pay to get my car back that just taking the piss as i didn't ask them to take it in the first place. But there is a bashed up punto sitting on the top of the road and has been there for like 3 months so I'm not sure about the 18hours thing.

I didn't want them to be able to take my car in the end but because there was other people in their cars all queued up and were looking i couldn't do much i mean especially as they were from the council. They said to me apparently its meant to be a police matter. They bought wheels along with them which they put onto the car which i find a bit messed up. I wish i knew who complained about it because i would take his wheels off and complain to the council and then they'll know how i feel.

my dad had a car parked out side our house for 6 months, we get traffic cars coming past all the time so i doubt that 18 hour law.

My polo broke down in Nottingham and I left it outside my friends house on a public road for months.

Then I had a phone call from the council to remove it because some thought is was abandoned.

The council should of contacted you first.

Have you phoned the local council to check if they has been complaints.

I'm not really that surprised if it was on bricks! This is very much a "I heard somewhere that..." but I thought you couldn't repair a car on a public road, and if that's true then surely being on bricks will be closely related to that.

It was on bricks for like a few days. But the fact that there was no warning makes me think this is illegal?

on the phone to them right now so lets see what they have to say... wtf! they said if i want the car back theyll charge me £230!!!!! and if i want to scrap it its free. she said that someone complained about the car being hazardous as its sitting on bricks. So they had the car inspected and they took it. i mean like i should of got a warning or something. So I've asked for certain bits off the car and they said they will contact me but they cant guarantee anything.

i got 2 cars sitting outside my house with no insurance at the moment i just keep switching the places they're parked so the neighbours dont get iffy lol

i dont get how they can take it though think if some pikeys nicked your wheels and left it on block why does that give them the right to take the rest of the car???
