there as to be offical notice up somewhere on the wall or a sign near saying that you can't park there for whatever reason,so check if there was,failing that a quick note from your GP and photocopy/e-mail it to them ( i'm a pareamedic) and if that fails do you have a consumer show on your local radio station as there always good for adverse publicity for the bunch of robbers...

lastly.........an appeal on here as if we all chip in £2 then we will right a wrong for a fellow Dubber

lol yeh i agree I haven't had a parking ticket in a while but if i ever caught one giving me a ticket could you not just smash up his little machine and and drive off then he has no evidence lol

i removed a warden from a car of mine years back,didnt assualt him,just placed my shadow over him and he walked backwards for around a mile lol,never got the fine

but things are different now as they take time and date stamped photos so your buggered either way.

if you have a health condition then fight it all the way and youll win,i would go to the doctors and say I'm depressed from the event,might help for compo stakes?if you wanted to?you pay your taxes so why not get some back

DKnight, I dont see why you're taking this so seriously. If this is a PCN handed out on a private car-park by a private car park enforcer, then they cant do squat. As many have said before me, the contract is between them and the driver of the vehicle. You can just refute that it was you who was driving, and under law you are not required to tell them who was the driver at the time. This is completely different than when you get a ticket from the council nobs when parking on a road, because then the contract is between them and the owner of the car. :)

well they replied saying that they are right and they will be handing it over to a debt collection agency, which is annoying as i have told them i am not paying it, hand it over to the law, a judge to decide as i am still questioning the reasoning.

Idiots, debt collection agency, in other words 16 letters saying they will be knocking on my door and scare me.

All a debt collection agency can do is harrass you for the money. They can't, however, harrass anyone else... for example, someone you live with.

Yeah and debt collectors can't do squat until they have been told they can in court. Private parking companies like this will NEVER, EVER take things like this to court as they wouldn't have a leg to stand on.

It's something to do with contractual law, the 'Parking Charge Notice' they issued you with is actually an 'unenforceable invoice'. It's like me saying to you, 'if you read this next line that I have written, then you owe me a million pounds'.

Obviously councils issuing the ticket on public property is a different story, but for a private car park you don't have to worry at all.

They are all just scare-mongerers who will prey on the easily-intimidated in the knowledge that the majority will pay. The best way of doing things is to make no correspondence with them at all, as correspondance makes them know you are hastled by it and are considering paying and they will hastle you for that bit longer. Just do nothing more.

If you do happen to see any debt collectors come knocking, just tell them that the debt is in dispute with the issuers. They will have to walk away. But this of course, won't actually happen.

It sounds like a really grey area to me, like those 'bounty hunters' in America that basically use their citizens arrest rights on people that the real police can't be bothered with..

I mean what can they do? knock your door and ring your house?

Surely if this dispute is between 2 private parties and not the council, government etc, then the police would be neutral.. I know i wouldnt stand for some twats in £30 suits knocking on my door for money..

Basically, that's it.

No powers of entry, etc, that's baliffs, which debt collection agencies aren't.

Oh, and if you tell them a debt is "in dispute", and preferably give them evidence of this, they have to fuck off. If they don't, it's unlawful harrassment on their part, ie, they are committing a criminal offence.

I work at a college and our car park is leased and run by Euro Car Parks. At the time i was also a student and hadn't recieved my staff car park permit & had my student permet and with that i have to pay £1.50 but i didn't bother and just parked to collect some basketballs for coaching and left to find a ticket on my windscreen. Was £30 if i payed in 14days and £50 afterwards.

Went and complained the next day as i was late for coaching anyway and the parking guy said sorry and took the ticket off of me, thought great, that's the end of that. A month later i got a letter through saying i have an outstanding fine of £50 and i must pay it. Went back to the parking guys at college and he said he'd call them up and cancel it. Sorted.

Or so i thought....i then got another letter saying they'd pass it on to a debt collectors so back i went to the parking man and he said he'd sort it and i got him to sign and date the letter saying he'd cancelled it.

I then get a debt collectors letter saying they're chasing up the debt which is now something like £80 and i need to pay up in so many days. Was annoyed by this point so just ignored it, i had proof the ticket was cancelled. I then get a bloody phone call from them on my house phone - something which i'm pretty sure is illegal. She was a moody bitch and telling me i need to pay it and how the attendants don't have the authority to cancel tickets blah blah, i then told her i wont be paying it and she hung up on me!

Marched straight back to the parking guys and luckily the regional manager was in and showed him all the letters, the signed letter saying it was cancelled told him i'd been phoned at home and i wasn't happy what so ever. He apologised sincerly, told me they shouldn't have phoned me at home and he cancelled it for me there and then and gave me his card if i ever had any other problems...

Sorry, turned into a bit of a rant there lol. What i'm saying is you'll find ALOT of info on the net and dedicated websites to private parking companies - most will tell you that you haven't signed a legal contract so the tickets is invalid and they can't prove you were driving as the only info they get off the DVLA is the owner of the vechicle but that's not to say someone else was driving your car. But i HAD signed a contract with the company and still got my ticket cancelled! Don't pay - dispute it or simply ignore it :)

I had parked in my dorm car park awhile back, to drop off some shopping into my room. I later come out to find that I've had a PCN issued, and a clamp put on my driver side wheel. Phoned up the muppets and threw a hissy fit as to why I was charged, and they said the parking guy could not find a pay & display ticket in my windscreen, and he had not bothered to look properly to see that it had was on the other side. Lo and behold, the guy said I'd have to pay up £150 before they could come out and take the clamp off. An hour later, took off the strut arm, removed the clamp, put strut arm back in, rode home with a smile. :)

These people fucking rile me, if a pikey plauge broke out only killing only the free loading, thieving, dirty tarmac loving scummy imbread bastards, the world would be a better place.

The "Debt Collection Agencies" are just a tactic, and are nothing more than a different typeface from the same company.

These letters will make the majority of people pay up, don't do it, you don't have to.

well i get regular letters from them, 3 to date i think, i replied to the first, and then the second, basically saying i do not believe you are the judge to say weather i should have parked where i did and why i did, therefore please take me to court.

maybe cos he could have collapsed and died while he was trying to 'pay&display' or even worse could of collapsed at the wheel sending him head on into a primary school killing loads of kids

but instead he pulled in to to get an emergency supply of suger to restore his blood levels, and the fact it was an emergency should mean he shouldnt have to pay the fine. my gfs mum got out of a speeding fine when she was rushing someone to hospital
