haha, the 'final letter' it most definately is. final contact from them you will ever have I reckon :)

oh and i don't know if i mentioned that i was in the same process that you were in dude, but i got a letter from the 'debt collection agency' handling the case after about 5 previous letters from them which basically said 'well, we've tried contacting you but had no luck, so we have no choice but to pass the debt back to the issuing company'.

have heard nothing from either company since, and that was around 2 months ago, possible more :D

Are they a member of the british car park association? If they are you can challenge through them, they have their own code of conduct and if the company gets challenged through this they tend to back down. My mate just got his son off a ticket, the little sticker had fallen off the window so they tried to fine him, they challenged them to prove he hadn't paid for a ticket, due to it going down behind the dash., took a few months to sort, and a few letters. but justice prevailed

well i continue to get latters, and now from a "graham white" solicitors, and the figures do not add up at all, latest letter said £141.12, and now if i do not settle it it goes up to £207.25, and it shows the cost break down and it no way mentions the £141.12

they are idiots, threatening court action, like i said straight from the begining!

there are so many errors and cock ups in their letter, they go on about effecting credit rating, baliffs, and then the last line in the letter

"contact us with your proposal for settlement within 7 days to avoid the possibility of this action"

I'm just glad they are wasting a bit of their time and money, as i am wasting none of mine

also it is funny how i got a letter from a "debt collector" before a "solicitor" i use both terms loosely as i do not think either are

hopefully the last letter now!

haha it does make you wonder sometimes don't it

they're nothing better than thieves to be honest, glad you know to hold your ground dude hang in there

mention the diabetes, it is a very serious issue, would they rahter you parked ina disabled bay or passed out at the wheel and caused a crash, and state that you parked in the disabled bay furthest from the shop because nothing else was free, shoud be cool

i have told them the details already they dismissed it and said it was not a good enough reason, and my reply to that was, you are not the people to make that judgement, so take me to court

the logic behind it is just so weird, I've stopped using staples and bnq now in protest lol

Man I remember reading this from before.

Total fair play for standing your ground on this. People are such sheep when it comes to this sort of thing and I think standing up for this bullshit is justified.

Although different circumstance reminds me of when I shared a flat with a number of people who never paid their share of Council tax in Glasgow even though I made every attempt to communicate with the council and them about paying my share. I was the only one between about five people over three years who paid so ended up liable for the whole lot.

It ended up going to a debt company and even though I was quite unwell at the time with depression and on benefit the fuckers froze my bank account. They had actually got a hold of my parents address. After about three years of stress and agreeing to pay £20 a month of the other bastards council tax a mate eventually tracked them down and it was eventually sorted.

you sound nervious but dont be. i cant tell you how many tickets I've had so far this year. council, none. when you get one from council theres not much you can do. but whenever you get one from private. NEVER PAY IT. only a complete idiot would pay it. there is no point contacting them they will just go through the exact same routine with everyone. and sadly, a few will pay this because they are scared.

whenever you get a ticket from this private cowboys. you simple write a letter and say "With regards to bla bbla bla on such such date. i will not be paying the fine as it was not me who was driving." from then on you will get a letter which will most liekly not even acknowledge what you just said but say you have ot pay the fine by such such date. then another one telling you bailiffs will come round. just send another letter back telling them if they contact you one more time you will have to inform the police for harrasment.

i thought i would make it a littel more fun the last time i got a ticket. si when the ticket came through i wrote back saying i will have to pass this on to my solicitor to deal with who will advise you of his fees which msut be paid. they sent a letter back they alwasy send. evenautly i sent them a bill for 700 pounds which would cover me legal costs. i then got a letter through saying bailifss will be paying me a visit (before i even got a letter telling me there taking to court lol). they are a compelte joke. clueless.

Right long story short i had to head over to leeds today from huddersfield, set off on my journey and got about 5minutes in and like a nob realised my blood was low (diabetic) so i rack my brains on where to stop, passed football stadium, pulled into retail park, furniture shop, bnq, currys staples

so i remembered stables had some easter eggs chocolate shit last time i went in, so i drove over, all the 6 parking spots outside it were full apart from 2 disabled spots and 2 mother and baby spots.

So next door is allied carpets, shut down for about a month now, so i park in the disabled bay next door to staples, outside the place that is shut down.

go in, grab my chocolate, come out, and spotty greasy bastard is giving me a ticket, i was in there for all of 2 minutes, he clearly was waiting.

So i tell him and he gives me nothing but geek attitude, and he didnt even know what diabetes is!

told me i was making excuses and i shouldnt park there.

So that is that, £60 fine

Now i cant help but feel hard done by here, i never park in disabled bays, so much so that i didnt even have the balls to park in the ones outside staples, and parked outside the closed shop.

I'm not going to pay it to be quite honest, as its a bit of a piss take, do i do right?

Then i return home to find pikey's rifling through all my stuff round back, what has happened to this country, does no one work for a livign anymore?

All i'll say is this is exactly what life these days seems too be full of it really does get me angry i won't get in too anything long as i'll end up getting really mad :(

I think they were in the right giving you the ticket.

You parked in a disabled bay when diabetes is hardly a disability.

Regardless of whether or not the shop was shut, you were still in the wrong, there may hav been someone genuinely disabled wanting to park there, it was obviously a bit busy if there wasn't anywhere else to park. . . .

Congratulations on "manning up", admitting you were in the wrong and paying the fine & being responsible for your actions.

ring them, pay the original fine & get good Karma, obviously the amount of time you spend picking fights with people says something about you.

rich - so - if trying to stop yourself going into a coma isnt a valid excuse for parking in a disabled bay, what is.

Even so, part of the argument is that the fine is not lawful anyway. So with the same rationale, I am fining you £60 for being a dick. Man up and pay it. Be responsible for your actions.

TBH its too easy to get a blue badge these days, cough and your entitled to one.

If you work near a car park you see it. you do get the few genuine ones but some are blatantly taking the piss. (yes i know that not all disabilities are obvious having worked with both disabled adults and kids)

hiya mate if yopu write into the people concerned i.e the parking ticket office give them you drs details to confirm the diabetes explain the situation politly the will recinder the ticket it will take a few days but you,ll get a letter saying you dont have to pay they will probably ask you to take the ticket to there office and fill out a complaint form first tho this happened to me whhem wait for it i left my car in a pay and display c/pk and went to ask the traffic warden for change he didnt have any so i told him i was going to pop across to the shop opposite about 50yds away when i came out the shop with the change i went and got my ticket from the machine and he was actually standing there writing it out wankers

To be fair, if you get a parking ticket from anyone but the police/council - just throw it in the bin, dont even contact them. They are not going to take you to court since they know they will lose, they have no legal standing, unlike the ones from police/council who do :)

well had a few letters through, all saying court threat etc

had a random number ring me today, a mobile and it was a woman acting on behalf of the solicitors, curious how they got my mobile number tho?

she said the usual stuff and i said i had my reasons for parking, please do take me to court, and she said she will pass the information back on to the excel parking idiots

I'm really only updating this thread just for reference to other people who are in the same situation so they can see what actually goes on

5months, no payment, no court case, no balifs. Sounds like you win.

To be fair, if you get a parking ticket from anyone but the police/council - just throw it in the bin, dont even contact them. They are not going to take you to court since they know they will lose, they have no legal standing, unlike the ones from police/council who do :)

the only decent thing said on this forum. no offense but you dont and shouldnt and never should explain yourself to these people. they dont care, they dont listen, they are just trying to put preasure on you to get an easy 50 - 60 quid.

www.moneysavingexpert.com even this website tells you you should never pay a fine lol

and if you ever get clamped there is an easy solution...

tbh i get really pissed off with people parking in disabled spots who clearly dont own a badge. as a mum to a disabled child it also bugs me when people park in the mother and baby spaces, when they haven't got kids. (i cant get a blue badge til hes 3) - but i cant see there being any kind of fine for parking in a child space if you haven't got a child with u. ??? not sure

but in your case i cant really see why u should have to pay. i can kind of understand their way of thinking, at the end of the day its still a disabled space, and that part of the car park is not exempt from the general rules of the car park, just because the shop infront is no longer in use.

but if u can get out of payin the fine the by all means do it. i hate those sarky wardens who think they own the place. around here they generally just move u on, iv had it loads of times. but they are the council ones. you have more than a valid reason for parking there for 2 mins so tell them to do one.

i parked in a disabled spot once while my bf went into halfords, and as i was sat there in the car, this woman walked past my car and looked to see where the blue badge was, and cuz we dont have one she shook her head at me and started muttering to herself in disgust!

i was fuming! my DISABLED son was in the back, and fair do's we haven't got a badge, but he DOES receive the highest rate of disability so he is more than classed as disabled, BUT i cant get a badge til hes 3 because as hes a child he can be carried or put in a pushchair, hence no real reason to need to park at the front.

anyway - i told my bf when he came back, and he made us wait until the woman came back out of the shop infront....then as she came out he stormed over to her, and started asking why she shook her head etc.... then she started sayin how we shouldnt park there, he soon put her in her place when he mentioned our son in the back and that she hasnt a clue about him.... and omg she looked so sheepish after that.

i havnt bothered reading through a lot of the comments but i can tell you that you can disregard all the court action letters as they cannot take you to court unless its civil in wichcase make up your own solicitor costs and they will back down as the court will throw it out.

only government stuff ie council tax etc can get the bailiffs around and they HAVE to be court appointed ie you have been to court otherwise tell them to do one, I've had this loads from a loan i had, everytime they come saying they are bailiffs i tell them to piss of and there is nothing they can do as they have zero legal right to enter my home.

I've got a good parking story tho..

a mate of mine was out riding his bmx and parked in a busy safe car park and he paid his ticket and went of, he knew the time was ending so he came back to pay the extra fee to park more and then realised he larked his keys in the car, so he phones up AA and they are on the way out to him, naturally he stays with the car incase any pikeys see the keys and the ticket guy comes up to him and says hes out of time. my mate quickly points out that hes locked the keys in and dosnt want to break the window just to avoid the ticket and says can he buy a ticket now and then just hold it with him untill the AA turn up and he will put it on the dash. ticket guy refuses point blank to help him out in anyway and starts to write out the ticket, my mate is about to kill the guy and i think he knew it and knew he would get a tasty little court case if my mate attacked him so he was stopped and put to one side whilst everyone tried to reason with the ticket guy. he refused and basically called him a prick for locking his keys int he car wich is fair enough but no need at all to be like that. the ticket was issued but got let of when all the evidence was produced ie carpark cams witness reports etc.

tbf your boyfriend was totally in the wrong to have a go at her. while i don't think you were in the wrong for parking there i also don't think you can have a go at any one that takes a dim view of what you did because you would of done the same in her situation (because you wouldn't of known who ever was parked there had a disabled child) and as you say you get pissed off at people that don't have a badge parking in them.

id never show my annoyance tho cuz u never know that persons situation... iv got as much right to park in a disabled spot as any other person without a badge.... no right at all. thats not what i was saying. my point was that this random woman starts shaking her head at me and muttering, come on - as if u wouldnt get annoyed and question her? anyway this is kind of irrelevant, dont want to get into a debate or anything, just wanted to say how i can understand both sides of it. no you shouldnt park in a disabled space without a badge, but i dont think it was fair of the lad to get a ticket.....

not heard anything from these guys since i spoke with them by phone and asked them to stop threatening me and actually take me to court

Dont just think you have won yet.

My brothers a debt collector/warrant officer (who you have met), so i have a good understanding of what goes on, plus i did some training with him.

As far as I'm aware it goes to court when they want to make repostions ect, and gain entry to your property.

If it has gone to a debt recovery agencey they can chase you for as long as they like, but they cannot enforce any debt in court which you have not acknowledged after 6 years.

Usualy if you are a geniunly nice guy and are polite to them they can actualy help you out. They do get comission for resolving debt, even speaking to you they get something.

If you wish (and have enough money) take it to court yourself, make up random numbers of your own, harrasmant, loss of earnings, mental health effects and so forth....££££!

It does seem like they are bluffing, i dont know much about parking fine wise, but it seem such a small amount to take to court. Unless they are trying to rack up the debt to make a profit. The angencys Charge stupid amounts for the warrant officer/bailifts (whome dont recive the profits) just to make a call at you property.

So dont be serprised if you keep getting letters with more charges ect.

I'm with you on the case, keep at it, even if they do take you to court id say you will win.

I'm no proffesional btw :lol:
