ok so my car is SORN and is parked outside my house on a private, dead end road! I've been out all day, arrived home about an hour ago and the sneaky bastards have been round to my house and clamped my polo! gutted!!

they have clearly gone out of there way to come to my house as you have to come down through a large estate and then on to a private street.

i hate the government! TWATS!

what can i expect? will i have too pay this or will they remove it because they have made an error?

just after some advice, my rights etc.

Depends what they class as a Privet road, as it could still be council owned, thus not being classed as off road

If it belongs to your local council, its still on a public highway and can be clamped. It'll only be an error if the road is owned by a private person/landlord.

Its £270 to get the clamp taken off and then a fine of £72 which you have 12 days iirc to pay or theyll take you to court :(

guessing a neighbour has complained then. 1st things first.. give them a ring tomo and ask why its been clamped as is on a private no through road.

the road did belong to the people who built the houses oppisite my house but they ran out of money to finish the road and the council didnt want to adopt it! but as the the public have access to it, it might be classed as a public highway.

If highways have rights to it, then its been clampled legally. All depends who owns it and what rights the public have to access it.

If the roads private property, they have no right to clamp, like the police have no enforcement rights if you're driving up and down it like a nob. Same process they use round here if saddos are driving round sainsburys carpark like idiots - they wait till they pull out the carpark and flag them down.

you should write to your local council and appeal against it, as technically your in the right, especially having declared sorn aswell!!

But it was parked on a private road. It isnt open to the public.

While I'm at work, we're not allowed to drive the truck onto private roads as the local council arent responsible for them so if we damage them, the council have to cough up to the owner!

And as for the idiots in carparks, why dont the police pull in the carpark and do them there and then - because its owned by someone else.

I don't see how this would stop them from coming onto the carpark.

If someone is pratting about on a private estate this wouldn't stop the police doing something about it..... Its like saying, a car was being broken into on a carpark thats owned by someone else, but they cant arrest them until they are off the carpark? Bollocks lol.

They clamped my mates SORN MK3 Polo GT on the pavement... Costs to get it released was going towards £400 and it was only worth £500 so he just let them take it... T'was sad sad day...

Now I'm buying a Polo GT i wish i took the 421 manifold and 8k chip off the thing now before the robbing bastards took it away!!! Grrrr....
