My parked car hit by roadworkers. accepting responsibilty but..

Bit annoyed.

Road works started this morning on the junction round the corner from my house, (live on a main double yellow road so free parking around the corner) so thought id check my car.

Theyve smashed in the front of my polo :( . Theyve left there details so assume are taking responsibility.

My car is lowered and not stated as modified on the insurance. The wing, arch liners and bumper all need replacing so no doubt the coilies will be exposed.

1.What is the likely-hood that someone at the garage could declare the coilies and my insurance become void?

2.Any advice, if the insurance has a probability of becoming void, on what i can do to reduce chances?

- i.e. maybe if i raise the car on the coilies it could look more standars :/ ..dunno if it would help.

Bit worried about this,

i wouldnt even bother mate, the people in the garage wont say jack shit to insurance.

It's not the garage you need to worry about, the insurance will send out an assesser who will take note of the damage and its him that you don't want to notice about the coilovers. Some won't notice but some will be jobsworths and would probably take great pleasure in voiding your insurance, I think they will also bill you for any costs they have incurred whilst dealing with your claim up to that point (car transportation and storage, paper work ect).

This is the chance you take for not declaring mods though, you want to enjoy the cheaper insurance, you know have to see the flipside of it. Your best bet would be to try and get those standard shocks fitted again otherwise its probably gonna come down to if the assesser got laid that morning or not as to whether you will get screwed or not.

That's what I thought too, they would be coming out to value your car ready for repairs rather then checking your insurance details??

I don't see what this has got to do with your insurance, it'll be the roadwork people's insurance company paying for the repairs or whatever. However they will no doubt send out an assessor who may tell your insurance company if they find the car modified but not down as declared on the MID system.

You've only got yourself to blame if something happens, don't do the crime if you can't do the time.

They are hardly going to pay out if they can get away with it are they. If they find out your car hasn't got insurance and shouldn't of even been parked on the road they will tell you to do one and save themselves thousands of pounds.

We store cars awaiting assessment in our works car park for an accident repair place up the road, I got chatting to one of the assesser's while I was a on a dinner break a while back and he was saying how they are being told to look for any way to get out of paying out because of how much the companies are loosing due to dodgy whiplash claims ect

Try looking at the local scrappers, id rather pay out abit for used springs than having my insurance void.

Mclovin is right, i had an assessor come out to look at my car, and they took note and pictures and everything, and he kept mentioning them, he even asked to hear the car running, and this guy was just an independent assessor and the third party was paying for repairs, but i declare mods so didnt have to worry, and then some one hit me again and the guy who come out was there for about 5 mins and didnt say anything.

Luck of the draw on the day, for what its worth id be putting it back to standard, and think about declaring in future, saves alot of hassle and could save your arse one day.

Hang on a minute, that guy just damaged Wooly_9n's property. The company will have to pay for the damage they did to it. If their insurance wont pay, then they'll have to pay out of their pocket then.

If I crashed into a car parked illegally on double yellows,

...or in a car park with no ticket,

...next to a junction,

...on the pavement,

...blocking access,

...etc

I still have to pay for the damaged I caused. What's the difference? They should not have been parked there either.

If you can find me an example where the person got off in those above situations then I retract my statement. Otherwise, it stands.

i was in a car accident (i was a passenger, and it was my friend drivings fault)

the lad we hit has been banned from driving for invalid insurance (hadnt declared) and my mate spent £200 fixing his own car and that was that.

the assessor walked up his drive and said ah thats all i need to know and went (noted car was clearly modded from what was insured)

dont want worries? be legit, no sympathy for anyone who gets into shit situations for trying to save money.

someone crashed into the back of my mk1 golf gti some years ago, pictures had to be sent to the insurance company, they noted i had alloys and a stainless exhaust and just asked for an additional premium over the year to cover the modifications. they then paid out in full for a cash in lieu of repair for the car.

It's not quite as clear cut as that though - the AA case study merely states that Saxo boy's insurers refused to deal with his claim from the 3rd party on his behalf. I'm fairly sure that he'd still be able to recover damages from the 3rd party - but he'd have to do that himself. Then he'd have to deal with the rest of the fall-out of driving with invalid insurance and trying to re-insure his car.

intresting with the new laws regarding not having a car on the road if its not insured regardless of tax

if someone hits your parked on the road car,and it turns out your cars modified but not insured to be then not only is the insurance void but also the car shouldnt have been on the road anyway,should be sorn.

insurance companies will avoid paying out if they can,think this no insurance-not on the road law will favour them greatly

My insurance is with LV and I have coilies. When I rung about adding coilies as a mod the woman said I didn't need to as it wasn't a mod to the engine? She said as long as I don't put anything on my car that makes the bhp different it does not matter?

I'm guessing that if the worst comes to it and I am involved in an accident my insurance will be void?

I guess I should clarify that I wouldn't expect in a million years for the insurers to pay out in this situation. The OP could still get his car fixed if he could take them to court.

Yes, but I'd ring them again and ask the same question. If they give you the same answer (unlikely) then note down the person you spoke to, the date and time of the call. If they try and worm out of it, legally, I think that is enough to win in your favour should you ever need to claim.
