Well tonight i pulled up to get petrol, reached for my wallet, looked up and some idiot in a merc reversed straight into me!

Turns out his pump was out of order so he reversed to use the one i was at but 'didnt see me'.

Baring in mind this is a fully lit up petrol station and i had been sat there a good 2 minutes before the incident. He has abit of paint taken off his bumper yet the grill, bit under the grill are bent, the bonnets moved back and i cant open it :/

I took his details, phone number, reg etc and i have to ring him tomorrow but where do i stand? what can i expect? I've asked the petrol woman person to keep a note for the CCTV because it will be recorded.

I dont get how someone can be so stupid?

His fault.

Get a quote for repairs, if he doesnt like it claim it off his insurance.

Phone your insurance company up and say what happened but that your going to deal with it via his insurance, then phone up his insurance and start a claim from there against him.

Will still show up as an accident but will not touch your no claims as your insurance company were not involved.

And before someone says it doesnt work like that, I took a merc owner to the cleaners via his own insurance company, (mine were informed and did actually step in to give legal council), he drove into me and I dealt with it external of my insurance, and kept my no claims intact.

His insurance company sent out a assessor who gave me a cheque for repairs, paid compensation and paid for my physio.

If theres the cctv it will be very clear he hit you. So i reckon you stand quite well against his dumb self. I wouldnt have bothered claiming tho as his car wasnt really damaged. Insurance will almost certaintly write off your car if you claim, as it will be 'uneconomical to repair' as they like to say if your car is old or of low value. My Moms insurance tried to write her MK1 Golf GTI off when someone did nearly the same thing, but when the assesor came he decided it was in too good condition to write off :-)

the made a claim debate will ensue, but if it was a newer car and you might like it done without insurance maybe get hm to pay direct.

You can normally stop another company writing off your car- its normally only if its your own insurance thats the problem.

Saw some thing about this on facebook, gutted for you mate but as cymro says its a no fault claim so your no claims still stand. Saf mentioned in the past that when some one twated his mk1 golf and to save it being writen off he asked for cash to repair it (can't remember what the name for it is now, possibly some thing like cash in lue of repair?) And then you pay a garage to fix it with that cash

Cheers, would you say go to my insurance or Winns? My neighbour had his aston hit few months ago and he used Winns.

Any ideas?

personally I'd not go anywhere near the insurance company until you've tried to get the guy to just pay up himself. I'd have thought you'd get a few hundred for the repairs. Even for a non-fault accident your insurance will go up next year. Report it to insurance company as a last resort only in my opinion. It's sucks because insurance is supposed to be there for such things but that's just the unfair way it currently works.

I had a chat with Saf after my car got hit by some dick head, its called cash in leiu of repair, which means they dont rite the car off and just pay you out i got pritty much the full value of the car, how ever i got hit again 3 weeks after that and tried to go down the same route, how ever they wouldn`t do the cash in leiu, but they did give me something called a contract repair which was basically the same thing as far as i could tell just a different name.

Personally i`d stay well clear of the insurance company and try an get him to pay cash, as haysey said even if it wasn`t your fault it still bumps your insurance up, i had a quote with no accidents, and then added 3 NON FAULT accidents and it went up £600 :x .
