Does anybody know where i would stand as the driver if i had some mates drinking

beer in my car?

I've heard different answers off a few people saying things like its only ok as long as they sit in the

back and not the front seat. So, i put it to you guys. Has anyone had any experience relating to this

with the police?

I've always heard drinking in a vehicle is illigela full stop! doesnt stop me or my mates drinking when somebody else is driving though

I wouldn't have anyone drinking in your car just in case temptation got the better of you.

Surely if stopped and found alcohol in the car, they would put you on a breathalyser and your car full of "mandems" If your under the limit and your "mandems" are behaving properly they cant say anything. SURELY

But you could drive off and then go over the limit.

I wouldn't no man, thought thats how it works.

Road Traffic Act 1988 unless otherwise indicated. The section will concentrate on the following offences:

• driving (or in charge) when under the influence of drink or drugs (section 4);
• driving (or in charge/attempting to drive) with excess alcohol (section 5);
• failing to provide a specimen of breath for screening (section 6(4));
• failing to provided a specimen for analysis (section 7(6)).

[F16D: Arrest

• (1)A constable may arrest a person without warrant if as a result of a preliminary breath test the constable reasonably suspects that the proportion of alcohol in the person’s breath or blood exceeds the prescribed limit.
• [F2(1A)The fact that specimens of breath have been provided under section 7 of this Act by the person concerned does not prevent subsection (1) above having effect if the constable who imposed on him the requirement to provide the specimens has reasonable cause to believe that the device used to analyse the specimens has not produced a reliable indication of the proportion of alcohol in the breath of the person.]
• (2)A constable may arrest a person without warrant if—
• (a)the person fails to co-operate with a preliminary test in pursuance of a requirement imposed under section 6, and
• (b)the constable reasonably suspects that the person has alcohol or a drug in his body or is under the influence of a drug.
• [F3(2A)A person arrested under this section may, instead of being taken to a police station, be detained at or near the place where the preliminary test was, or would have been, administered, with a view to imposing on him there a requirement under section 7 of this Act.]
• (3)A person may not be arrested under this section while at a hospital as a patient.]

Basically, It would be frowned upon as its "irresponsible" but as long as you are driving and not drinking and not over the limit you will be Ok.

Your mates can be as pissed as they like as long as you're under the legal limit of the allowed alcohol level, and you are able to drive with due care and attention.

Passengers can be arrested if they give the law mouth at the roadside, as per usual. As long as you pass, and they all shut their mouths and act reasonably civilised, all should be well.

You can actually drink and drive yourself, but it's so frowned upon you'll have a hard time.

For one, being in full control of the vehicle - some people have been nicked eating Mars bars behind the wheel, some even smoking, so holding a bottle or can isn't gonna be ideal.

Then there's the alcohol level. Drink a bottle of 330ml Stella and you'll likely pass, as long as you don't have even a trace of a hangover. However, they'll make you wait for it to get into your blood before giving you a test, this can cost you half hour if they're generous. Also, they can, at their descression, be a pain in the arse and ruin your day even if they let you off without charge 12hrs later.

Finally, the press are worse than the police.

It's really harsh on some poor motorist who was doing 20mph and a kid ran out on him. He was on the brakes like lightening, but there was nothing he could do. On the front page of the local rag is a heart-breaking edit of how this has broken him down.

Until alcohol is involved. Even if one passenger had been in the pub for one beer several hours earlier, the word gets on the front page - clean driver is now a hated figure of shame, the neighbourhood are attacking him, his job is out the window for a start.

I have had no issues drinking as a passenger. Heineken mini keg on the motorway, its the shit!
