Poke and Stretch 'laws'.

Featured Replies

Hi guys!

So today I was driving sensibly, nothing silly.

I turned left off of a round about and a traffic Police car was waiting to come out of the turning I turned into.

I saw them looking at my car, I thought maybe they appreciated it...

I was wrong, I loo in my rear view mirror and I see blue lights after they span round on the roundabout..

You know the feeling, all of the blood rushes out of your body..

Pulled over, he instantly says that he just wants to have a quick look at my wheels and tyres, I was a bit chilled at this point, I thought they were fully legal...

So, within seconds he is certain that they are stretched and poke out of the arches too much..

He basically tried to scare me with telling me that he could give me 3 points per tyre..

Then he goes onto say that he's going to get someone down to clamp the car and I'll have to pay to recover it and get it towed home..

He goes on the radio and asks some questions, then eventually lets me go (in my UNSAFE) car, though I have 14 days to change my wheels and tyres (or stop them poking out of the arches.

This isn't the end..

I drive away, furious at how pedantic our country is and they follow, I'm pretty angry so I'm struggling to drive a bit..

Next thing I know, I see the blue lights again (yes, he pulled me twice.), he tells me that my rear light flickers slightly (it was daylight, there was no real need for lights anyway).

Then he spots a "CarPorn.co.uk" and a "Wheel-Whores.com" sticker, he says that they are both offensive and must be removed. At the road side.

At this point I was so angry I was almost in tears, I couldn't take the sticker off my hand is shaking so much..

Basically, the reason for telling you all of this is that I'd like to appeal this..

I've found a bit of information on the internet from this link: http://www.legislation.gov.uk/uksi/1996/3013/made

wheels, if there are no pointed or sharp features which projects beyond the external plane of the wheel rim, no wing nuts are fitted and there are no projections beyond the vehicle body plan form apart from tyres and wheel discs, if the latter have a radius of curvature of not less than 30 mm and do not project by more than 30 mm beyond the vehicle body plan form;

Anyone got any more info on this?

Can he legally remove my stickers?! Wheel-Whores stickers aren't cheap!

Do they expect me to buy 4 new wheels and 4 new tyres in 14 days?

Help! :(

Charlie

Here's a photo so you can see how much poke I do (or don't) have..

Did you remove the stickers or did he? If the latter I'd register a complaint, I'm no legal expert - but you have a right to go to court and let them decide if the stickers are offensive or not... As for your wheels, have you got stupid stretch and/or poke? What paperwork did you actually get given?

He removed one of the stickers, though he didn't leave me a choice whether I could or not, I had to remove the stickers..

I have barely any stretch and less than 30mm poke, I got a Vehicle Defect paper saying I've got 14 days to get it signed from a mot test center and returned to a certain office.

Cheers,

Charlie

I'm no expert, but him removing a sticker is criminal damage. Same as if you had front window tints and they peeled it off, so I'd file a complaint for that, if nothing else.

Take it to an MOT garage and get an impartial opinion. If they deem them to be unsafe, get some cheap steelies from a scrap yard to get you around.

I personally wouldn't class those stickers as offensive - they are advertising decals. Also, I had an (uncensored) "Why the F*#k do I pay road tax" sticker on the back of my golf, and have had coppers behind me, while the sticker has been on, and never been pulled for it. I also had a "Yes, i've paid my tax...... now go fix some f*~!#&g potholes" tax disc surround on the same car at the same time, and yet again, no problems.

Also - if they can't explain the full wording of the law, they can't charge you with shit, as you don't understand the offence you may (or may not) have committed (apparently)

If the wheels are within the law I would defo take it further, but be warned it probably would be a long and drawn out process. As for the stickers I would lodge a complaint about him, if it goes far enough it may help you if you can give proof that these are just car culture stickers and not meant to be offensive, although tbh you would have to be a very strange person to find the words "car porn" offensive. Just sounds like a copper being in dick in that respect, but I can see where he was coming from with the wheels as they have got a fair bit of poke on them, but if they are within the law then what can they do?

can you not just get some like mk2f GT trims for the arches? that way you can keep your wheels and they are still under the arches reducing poke?

That's not a bad idea, either that, or massive bolt on arches :p

Flare front arches slightly if they poke more than 30mm, then tell him to suck dick and learn the law!

BERGCUP IT!!!!!!

Charlie are.u coming to poloshow? I have a set of mk2 arch trims I'm selling? Just no front splitter but u already have one

I was told about my wheel whores sticker it would only take one complaint from a member of the public and they would class its as section 5 of the public order act.

Did I take it off? Did I fuck!

No one had complained so they had no reason too its not like it's illegal like limo tinted front windows etc..

As for the wheels maybe ask another police officer that's of higher rank for his opinion and what to do...

If this was already said appologies as I havnt read the other comments

Polo arch trims will add next to nothing, just get some of those bolt on arch trims that the lap scene boys use

surely arch trims you could fit so they hung over the edge more, my friend does it on his mk1 golf to make it more "flush" with his air ride.... still doesnt win best daily though :p

I've been reading through the vehicle construction and use regulations and as far as I can see there is'nt anything covering your problem, the only thing that they might use is this rule

Wings

63.—(1) Save as provided in paragraph (4), this regulation applies to—

(a)invalid carriages; .

(b)heavy motor cars, motor cars and motor cycles, not being agricultural motor vehicles or pedestrian-controlled vehicles; .

©agricultural motor vehicles driven at more than 20 mph; and .

(d)trailers. .

(2) Subject to paragraphs (3) and (5), every vehicle to which this regulation applies shall be equipped with wings or other similar fittings to catch, so far as practicable, mud or water thrown up by the rotation of its wheels or tracks

But as the tread area is still under the arches, I think they would have a difficult time in proving that mud or water would be thrown off the sidewalls??

Polo arch trims will add next to nothing, just get some of those bolt on arch trims that the lap scene boys use

With arch trims on the tread is JUST in the arch. Without them its debateable lol

The question you need to ask is, is your car fully legit? All declared on insurance/logbook?

Are the tyre sizes on the rims approved to be on a wheel of that width?

Fair enough saying the police were being a dick but if you start looking into it do you really have a leg to stand on?

1.3 8v on the log book

..

And, no - I'm running the incorrect size tyre (only very slightly), but so was i on my 6n when I smashed the shit out of the side of a clio, they weren't a problem then?!

My problem is the fact that they are so inconsistant, if it's law, then they should ALL enforce it and stop guessing.

They were saying that the previous owner sold me an unroadworthy car and I could take him to court.. hmmm :p

Maybe if this thing doesn't get taken from me, or breaks again. -_-

Lower arm now...

Yeah but if they want they can investigate, they clearly didn't before but if they want they'll do you for more than that, colour declared? Engine etc...you could easily lose your license and have a whole lot more hassle, I'd just take it on the chin, see what MOT people say and don't worry about stickers.

It's well known in the "scene" that stretch and poke is a massive fuck up grey area, people always say these "laws" but Iv never heard of any come back after asking the question
