Hi all

I sold my golf to a friend's friend but I didnt have the log book (I'd misplaced it) so told him there was no log book, but I did have the new keeper slip which he's sent off to DVLA to get the car changed into his name. DVLA wrote to me telling me someone had applied to be the new keeper, I wrote back saying it was fine and that id sold it on 20/3/12 and thought nothing further of it. I had a letter from DVLA on Friday saying that I was being fined £55 for not telling them the vehicle had been disposed of on 19/3/12 (conveniently the day before I sold it). They said the fine would be dropped to £35 if I paid within 14 days (sounds like the parking scam letters you get, right!)

My query is as follows -

Do I have to pay this fine as I have all correspondance between me and DVLA

If I do have to pay, why?

If I don't have to pay, why?

Is this something new?

What do I do next time I sell a car (if I lose log book again)?

They've also said that if I didn't commit this "offence", they want the full name and address of the dude I sold it to. All I have is that he was called Sam. No surname, address, postcode etc. And to make that worse, he won't give me this info because I told him I'd give him the standard steelies as well as the alloys (and the steelies have since been skipped as they were taking up too much room)

I had one of these a while ago and just told them it was all as per the application for a V5 that me and the buyer had sent them and I couldn't remember who it was.

They're just pissed off because they can't make any money out of him so are trying it on with you.

Right, so basically give em a call tomorrow and tell them to bollox then.

sounds fine to me and I can spend the £35 / £55 on vodka! Woo!!

I don't even bother phoning them any more, just write to them.

Tried phoning the number they gave, but funnily enough, it's only for payment, so no use to me.

I've composed a letter instead:

To Whom it may concern,

I have received a letter dated 19/06/2012, stating that I am now liable for a fine of £55, due to failure to notify of disposal of vehicle XXXX XXX. It is with regret that I must inform you that this fine will not be paid, as I have correspondence showing that I did notify you that the vehicle was sold.

Any further response received requesting payment, or court appearance will be deemed as harassment and will be actionable.

Just to update, I got a letter from dvla on Friday stating that they'd dropped the claim

No, women have baps, 2 of them! (I.e. "get your baps out!!!")

It's a bread cake as its made of bread and is cake shaped.

And I see it as an early birthday treat that they've dropped the claim, as it's my birthday today (:-)) so that means I can spend an extra £35 on vodka... Woo!!

Knowing the DVLA, they'll likely try and fuck you over.

Not sure if it'd work or not, but I'd say I'm not paying the fine as I wasn't given the full wording of the law which I apparently contravened.

I.e. (afaik) a copper can't just say "you're nicked, section 5, public order" And lob you in a van (although they all do) they have to know the exact wording of the law so you know what you've done wrong (you naughty boy!) and just knowing the legislation exists isn't enough because you could theoretically make anything up and pass it as law...

I get untaxed vehicle fine every 6-12months for a car I scrapped 8 years ago.

I just send a copy of the vehicle destruction and a short letter on why I'm not paying in their original envelope with return to sender written on it.

I got fined for a car a didn't sorn a few years ago, sorned it and paid. I then scrapped the car a couple of months later and sent the log book off to let them know, 3 months later hadn't heard back off them so sent a letter explain it was scrapped and I hadn't had an acknowledgment letter and still didn't hear back off them, did this twice with the last one being sent with another log book that was being scrapped, got a reply about the other car but again nothing about the original one.

So for the last 3 years I've been sorning it everytime a reminder comes though, well today I randomly got a new log book come through the post for it... Looks like micky mouse is getting a golf put in his name :lol:
