Earlier on I decided to drive to Lakeside as I had reached ultimate boredom and aload of my mates were over there (I had already told myself before that I was never going to go there again as all I've had is nothing but aggro everytime I've been with police telling me that my wheels aren't legal and threatening to take my car off me). Anyway after being pestered to death to come out I finally decided to take a drive over there, when I got there I see one of my mates parked on the side of one of the main roads so turnt round to see whether he was ok. I decided to park up a little road and put my hazards on as I didn't want to risk parking on a busy road with people driving like complete idiots. I walked round to see him. As I returned back to my car a police officer was parked in front of my car and was taking down my number plate, as I walked over to him he asked if it was my vehicle and then told me I'm getting a fine for 'Unnessasary Parking' even though I was not parked on any lines? Can they do this?

copper sounds a right jobsworth (i.e idiot!). did you explain to him the situation?

id be obliged to go to the cop shop and contest it in a calm manner, explaining the full situation (didnt wanna risk getting rear ended by a speeding idiot) and pointing out your hazards were on to alert other road users to the fact your car was there. as long as you was parked sensibly and not right on a junction (15ft from junction i think it is) or in the middle of the road then i cant see the fine will stick.

Well I did try and explain it to him but he wasn't having any of it, I also mentioned to him about me having my hazards on and his response was 'well that blatantly shows to me that you knew you shouldn't have been parked on the side of the road' I didn't quite understand what he meant by that but I just left it, took the ticket and parked up feeling a little pissed off lol. Will take a trip to the local police station and question it.

write and complain to complaints service, tell them police did not use any discretion and you'f have moved if asked etc etc, as far as you know you were parked legally etc

If there were no parking restrictions and you were taxed, accept nothing, sign nothing, pay nothing.

Most times you youngsters get wrapped it's because you accept it. If you let this go to court, the cop will not have a leg to stand on - he's really just asking if he can nick you. That's always the case whenever it's out of court. Do not say yes if you don't believe you were doing wrong.

if youve pulled up for no reason (i.e, you haven't broken down) then sadly he is within his rights to do as he has done, they tell you all sorts of crap like your causing obstructions ect, basicly youve been targeted because of your moddified car, had it have been a middle aged woman in a ford focus then they would have asked if she was ok and if she needed assistance but sadly your a young lad in a moddified car so are in the wrong in the eyes of the law. best thing you can do is say 'yes sir, no sir, three bags full sir" then just take your producer in and forget about it

I'd like to know this too, if parking at the side of the road to talk to a mate is unnecessary parking then I'm guilty of it all the time. Would that not make parking outside a mates house while you go to talk also unnecessary parking?

As I see it if there are not restrictions and you were parked safely and in accordance with the law (IE not just dumped in the middle of the road) then I can't see what they can do about it?

I've said enough times before, the police are only there to report you, with certain detainment powers if necessary. But they've taken to doing deals outside court, on their daily rounds. They'll literally offer you a fine and/or points, out of court settlement. It's then up to you whether to accept it or not. And as they get so many people who go for it, they usually get slack with the difficult ones and make mistakes in their responsibilities. These mistakes loose them court cases - but only if they're sussed out and exposed in your defense.

Now the upside of letting it go to court is that you can win the case, and the bill is paid for by the tax payer, and your enemy gets a slap from their boss.

The downside is if you get snowed in court, end up on a bigger charge, and you should've taken the deal!

You need to know your shit. You need to know if they're trying it on, or if you can beat them. Know the laws. I have beaten them, it does happen. They can only enforce the law, if you're not actually breaking any specific law, they've wrongly charged you and the charge then isn't legitimate, then you really should consider fighting it.

I've also been a victim of this "bored policeman making up laws to victimise modified car drivers".

Our local dub meeting location is in a pub car park, after the pub, we go to Sainsbury's to get snacks or whatever, and after we will stand by our parked cars that are in the furthest corner of the car park and chat. We're out the way, not disturbing anyone.

One night a policeman decided he was bored and would target us, and to no surprise targeted me, as I wasn't parked in the lines properly. It's around 10:30pm, the car park is fairly empty. There's a group of cars near the door, (normal shoppers), there's us in one corner (sitting in the car park, yes, but most have been in and bought something), and in the opposite corner are the local chavs, who haven't been in to buy anything, are sitting in their cars revving there 1.1 saxos, blasting their subs etc, and the police chooses to come over all guns blazing because my car isn't properly parked in a parking space. Fair enough I should probably have parked properly, but hey ho. If he had come over and kindly asked me to park properly, I would have replied "no problem". But no, he ignores the noisy ASBO's in the other corner, and thinks it's necessary to have a go at me for parking the way I did, threatening to take me into custody for not having my licence on me (again my bad, but not a custodial offence), and best of all, telling me and my friends we are.... wait for it.. "anti social driving". Yeah you read that right, anti social driving.... His explanation? "you shouldn't be out driving without a purpose. So now APPARENTLY, it's illegal to go out for a drive... Everyone that gets in their car and drives down the road must have a purpose to do so. And parking in a group like we were was, and I quote, "scaring elderly people". I'm sorry, but I think most people's grandparents, including my own, are in bed at 11pm. Not at Sainsbury's doing their weekly shop!

And after the big speech, did he take me into custody? No. Did he give me a ticket for my bad parking, lack of licence on me, or my "anti social driving"? No. Did he take my details, or my number plate? No. Because I was over polite, moved my car, and generally pissed him off even more for not retaliating like he wanted me to, he left, alone, without success. Pillock..

i think it all depends where in the country you live. dont get any problems round here and if i get pulled over, they're quite sound and dont muck about making crap up. i do know afew of them, one of them quite high up so usually scares em off if they start making bogus rubbish up.
