right, so basically it all happened this morning...

I was at the petrol station in my town, waiting to get out. There was a car infront of me.

She pulled out, i checked if it was safe to go each way, then my mate shouted STOP! and i ran into the back of her because she had decided to stop in the middle of the road!

the cops turned up as they were driving past and said it was my fault which i know..

I have a dent in my bonnet and my pressed plate is fucked but thats about it, thanks to having a low car, my car went under her number plate (she had a subaru legacy estate) and literally left a few paint scratches and thats all on hers.

we exchanged details and went out seperate ways, but she said she was going to ring my insurance company. I'm only 3rd party fire and theft and have only been driving since april.

so 2 questions..

1. will i have to pay out my excess (£150)

and 2. will this affect my no claims as i haven't actually claimed myself.

I dont yet know if she has rang them but I'm absolutely shitting myself.

can anyone help? :-(

If you've got her number phone her up and ask her if she'll consider getting it fixed without the insurance!

You won't pay your excess because you don't want your car fixed, but you WILL get shafted next year!

Persuade her to try and help a new, young driver out by not going through the insurance; you might get lucky!

No that is incorrect, as it is your fault when she claims she will be claiming from your insurance company, and yes you will have to pay your excess and yes you will lose your no claims.

My advise is phone her up and try to talk her round as you will get stung come insurance renewal time.

Also if she was ok at the time don't even let her think she can claim whiplash

Well my dad knows her pretty well and used to go out with her when they were younger, but he dumped her so already I'm in the bad books. I didnt get her number, but i've asked my dad to send it me so should have that soon, and she cant claim whiplash now as the police asked if we were both fine and we both said yes. the police have booked it and everything just shitting it about next years insurance now...

Whiplash doesn't present until the next day, usually. If she's contacted her insurer, they'll likely tell her to go to the hospital, if she didn't go on her own accord. And it's hard to prove you don't have whiplash. But you'd have to be a right nice person to claim at such low speeds

So why have an excess on a third party policy then? If you're only third party, you'll never claim for your own car so the excess is not needed, if what you say is true Pete. Is this the case?

See, that happened with the misses' car. When it got crashed (only a minor bump), I told them I didn't want the car fixed, and they said that's fine, I don't have to pay the excess?

I know, well, the Kia is fully comp, so I've never read into it, but I made sure with the insurer when I phoned that I didn't have to pay the excess, because I thought she'd got it wrong the first time, so asked again.

But, sure enough, it doesn't need paid because I didn't want the Kia fixed. Hmm.

That is incorrect, he won't have to pay his excess because he isn't claiming on his insurance. The excess is only for self claims

Si he has 3rd part fire or theft so his excess would only come into play if his car was stolen or burnt

Cheers for all the help guys. Might have a bit of luck though.. my dad got in touch with her this morning and they haven't rang insurance yet, but now apparently her boot wont close, so i'm gonna see how much the spray on part of the back bumper is and how much it is to fix the boot, my next years insurance at this rate will be up by £500. so if its less than that I'll give her the money for it, if not its cheaper to go through insurance.
