problem on ebay..what can i do?

Hi i need abit of advice on what i should do? i recently bought an item off ebay and paid for it, a few days later i recieved the item but it wasnt as described and damaged, therefore i opened a case on ebay for " item not as described", the seller then messaged me and told me that he will pay me on paypal and i should close the case, so i closed the case and recieved the payment from the seller on paypal. but now the seller has opened a dispute on paypal for item not recieved and he has got his item back and now wants the money back aswell? is there anything i could do? please someone help.

Do u have a receipt of postage form when u returned the item if so u can use this in you are defence.hope u get it sorted pal

Did you post the item back recorded? Or tracked? If you have any sort of receipt to show you posted it back then there's jog all he can do!!

If you didn't I don't think you can do much as they will look back see you opened a case against him, cancelled the case and settled it with PayPal (which he can use to his advantage to show he refunded you)

I may be wrong but I'm pretty sure if you don't have any form of receipt of the item being posted back you will be charged.

yeah i have proof of postage and it was recorded but he has said that i didnt send him the item back and that the box was full of newspapers, he has continued to lie and wants a refund for something he has already got and he has told me if i dont then he will contact the local authorities and take further action towards me, i am now in the middle of something i didnt do and very confused.

I'm not willing to give him refund as he didnt purchase the item from me in the first place as it was his own item to start with? he has used tactics so that its a WIN/WIN situation for him, and now i dont have the power to do anything as hes the one who opened the dispute and has more power now as hes opened a item not recieved? so I'm guessing i lost the money and item and paypal will probably take his side as he is the buyer.

That's why you should never have closed the case, hate eBay, it's full of absolute wankers.

I got shafted on ebay by some rear LED lights , and its a member on here too!!! (Name of garry , Yellow 6n2)

Paid £80 od quid for some "professionally" converted rear LED 6n2 lights

Recieved 2 hacked light shells and ONE cheap led strip , Luckily i took pictures of opening the package and during ... it was a state

A select few on ebay want to pass their SHIT on for a quick buck... I recently got diddled out of a "genuine laptop charger" . which when recieved was a cheap chineese knockover thats 1/5th of the price... then he even admited via ebay message it was fake but took me like 2 months to get a refund via a case..

You got to watch out for ebay now , its full of cheap shit and people who dont seem to understand the legailty of it

I'm interested in some wheels on there atm, but the picture only shows two and there isn't actually a mention of there being 4 so I'm refusing to bid until he replies to my question confirming there is actually 4 wheels. Paranoid? Probably slightly but you can't be too careful on there these days

Tell him the local authorities can't do a think as you have proof of postage for the weight of the item and that's to heavy for newspaper and call his bluff tell him you have pictures of the item in the box just before you sent it con men are truly starting to piss me off but the art of a con is being able to lie and if you can lie better you win its never a win win unless your the winner

You've got proof of postage, tell him to get fucked. If he says it was full of newspapers the onus is now on him to prove it (impossible obviously). Make sure you leave feedback warning other ebayers that he's a scamming cnut. Name & shame anywhere & everywhere. Have a nice cup of tea & stop worrying about it.

I sent for a replacement screen glass for my old phone, along with a new battery, house charger and car charger. All from different sellers. I was careful to ensure they were at least claimed genuine parts and had all the right markings.

The car charger took about 28hrs to charge the phone, the battery lasted ten minutes, the 'glass' screen to replace the original smashed one was actually made of soft plastic yet still cracked in the first week, the house charger was temperamental.

Allegedly all different sellers, clearly getting the parts from the same black market.

I can't take anything seriously on there now.

Similar thing happened to me, got proper shafted-live and learn.

If I were you, I would cancel any direct debits for paypal from your bank account and withdraw any balance you have in there. I had proof of postage but still they tried fleecing me.

if he's saying payment not recieved theres not alot will happen...paypal wont pay him worst case you get a strike against you for not paying , he cant leave bad feedback for you either

Did you contact him through eBay message? If so eBay should be able to work out what is going on from that, they can also review Paypal transactions if required. It will be easy to sort just keep every single piece of communication you have with the guy and postage proofs and you will be fine. This happens a fair bit as it's a seemingly easy thing to do to someone, just be sure to provide an accurate and comprehensive account to eBay and hand them all evidence you have; screenshots, photocopies etc (be sure to keep copies too), leave nothing out. Also don't just email them about the issue, call them as well because they do get lazy on stuff, my boyfriend had this issue with them when he was in a similar situation to yours with a fake ECU he had brought.
