If he would have let the farmer know whst had happened, then maybe this wouldn't have happened, not all farmers are cocks, I broke down once and my car ended up in a field as it was the nearest pull in, called at the farm house to let him know what had happened he was fine with it, the went back and lent a chain off him as my mates tow rope snapped, which I returned the next day.

It was snowy and looking at google maps there, where the feck is the farm house? He'd be walking in snow for hours finding who owned the field... he'd have had better luck asking one of the sheep.

He did say he left a note in the windscreen .... probably, which the farmer could QUITE EASILY, took photos of car and numberplate etc and called is own land insurance up or what ever they have for fences. lol.

I understand the driver being pissed off but this was deffo way way too far fetched to solve his problem.

Have to agree, if he broke the fence the insurance would have paid for it, theft & criminal damage is not the solution.

Well i did the same thing last year, i won't hoare the same pics out again as we've all seen them but this one from further back and showing the area is probably a bit more fitting..

My point is how i handled it. The first thing i did was get a lift home from a passing copper, after helping him scrape the windows of the panda car at the nearby police station. He knew how icy it was, so as far as he was concerned i'd had enough grief already.

I was driving uphill away from a T-junction i'd just pulled out of, not down it into the 'slow' zone. But being a 6am frost following a damp night, ice was only forming at the bottom of hills, which caught me out. And the copper had a bit of a twitch himself.

Having just finished a nightshift i needed sleep, but he waited whilst i made the area as safe as i could first. Collected tools etc from the car, disconnected the battery, and ensured the fence was held up enough to do it's job until i could find the farmer. I got the lift home and picked the mrs Golf up - then went back to find the farmer.

I found some workers in a nearby unit who knew the farmer, so i sorted it out with them. They lifted the car up and parked it on the track at the top of the hill ready for the breakdown company to sort out..

So we ensured the area was all agreeable for me to go get some kip, and i left my details with them for the farmer to get back to me. When he did, he was fine. He said it's happened a few times but he appreciated the way i'd handled it. I had respect, i realised i'd gatecrashed his yard and did what i could to sort it. I don't know how much the fence cost him to sort but i bunged him £50 for it and he was happy - he's since repaired it properly himself.

Farmers really have a crap view of 'townies'. Brats, most of them. Like the old bill, they only need to be treated like human beings and they aren't that bad.

I'm wondering if the owner of the Citroen C2 has some humanity skills to learn, if he doesn't wanna get stung like that again.

to be fair if i'd just crashed my car in the middle of nowhere in the snow the way it was last week the last thing on my mind would be to try and find the owner of the fence unless i knew he lived close by

Hope they do, whether he told the farmer or not its no excuse to write his car off for him out of spite. If he really wanted to get back at him he could of fenced around the car and left a note explaining that if he damaged the fence he would be prosecuted for criminal damage and he would have to pay the famer to remove the fence. To me that seems like a fair and just way to deal with it, the famer get the coin to fix the fence and teaches the car owner a little lesson in the process, car owner might be inconvenienced a little but no more than the famer having to repair his fence.

It is much harder to prosecute someone under criminal than civil law. The police will only take it on if they think it'll get past the CPS. Beyond all reasonable doubt vs. balance of probabilities.

The farmer's admitted moving the car with his forklift. Also it sounds like he's launching a half arsed claim against the driver over his fence, which has been referred to the driver's insurers.

The insurers will be unlikely to pay out for the fence if they are going to have to pay out for the car.

The insurance will just refer any claim from the farmer to their legal team.

If it goes to court, the farmer will have to convince the court he acted reasonably and there was immediate threat to his property.

He's been quoted "'If it had been a £50,000 Bentley I might have left it in the ditch." So did he have to move the car? Why did he not contact the police or the driver?

Did the driver act reasonably? Given the circumstances (poor weather) maybe? If a similar incident has happened at that spot, has the farmer proof he alerted the local authority to the problem?

I can imagine if it does go to court, even if the court rules 50:50 it's going to cost the farmer quite a lot once you add the costs for the legal team and the court.

The farmers insurance may not cover him if they feel he acted maliciously.

So forget petty revenge, the farmer may well find himself with a big bill.

Had no time to react just went under the car up to my waist smashing my head on the floor.. My car slid 10-12ft back from the impact with me under it. Fantastic Friday night... Hip, neck, knee lower back and the back of my head are in clip

Wheh the police turned up and I'd managed to get from under my car he stated to try to blame the other car who was not at fault so I was shaking my head, he lipped off I went for him to crack him the police dragged him away for his safety and one fell over trying to grab me but missed..

The police didn't breath test anyone I was amazed!!

Police wouldn't give me his details through apparently fear of basically revenge from what happened

I've now logged a formal complaint against the officers that attended! Just show how some of the cops are, I went to my local station to try to get the driver that hit us details, to find they had reported we had them NO THEY WOULDBT GIVE THEM TO US, that no one was injured I WAS TRAPPED UNDER MY CAR AND DRAGED DOWN THE ROAD and to top it off they didn't breath test us even though its policy to do so in a RTI.. Turns out they new the bloke who hit us so it's obvious they are covering for them.. Looks like a sort of investigation is going to start now..

badly bruised ribs,

bruised lungs,

dislocated my shoulder but I don't remember doing that, as I spend 5mins in shock just laughing at nothing :/ my ligaments in my shoulder are torn

bruised lower back,

Concuson,

bruised neck and back of my head are killing

and I have also still got a headache iv basically got whiplash all over my body all are deep tissue injuries could take months to get back up to health
