Just want to vent a little really. Yesterday afternoon, 2.30pm. My girlfriend and I got hit head on by a Mitsubishi Shogun SWB. Not only was the driver speeding in a residential area, he cut across my lane to make a right turn on a blind bend one of which locals come to a stop on. He hit me head on pushing my car sideways, once I got him out of the car. Because I really do suspect he wasn't going to get out by himself, the police showed up.

The driver then did not get out of the van, therefore I believe he was taken away under for drink driving. Not only that he didn't even have insurance. Landing me with all the hard work, and no car. I don't even get a courtesy car because there is no other insurance company to take the money from. Unreal.

If my car was deemed fit for repair, I will be required to pay my excess of £450 before work can begin, attempts would then be made to retrieve from the other driver of which I imagine slim chances.

(There is a couple of things missing from the story, but I'd prefer for everything to go through first.)

Absolutely gutted for you mate. i think the best way for you to go is taking it to court. Go seek some legal aid or something sure they will be able to point you in the right direction!

wouldnt you insurance cover the cost of legal fee's of taking the coont to court? and rape him for everything hes got?

Went to hospital yesterday, have a personal nurse contacting be within 24hrs.

And my insurance has sorted me out legally I think.

But it just annoys me so much that he was pissed and kids were around, could have easily killed someone.

something similar happened to me. was a bank managers 4x4 range rover rolled dwn a hill straight into back of me. He had been drinking all his lunchtime and hadn't put handbrake on when he got out n left it out of gear.he was insured and I had to chase after him into an office when he moved his 4x4 back. I had a witness who agreed it was his fault and damaged my car. the guy gave me his address and details and agreed his insurance would pay for the damage. I then told him I was calling the police to cover my own back as well. when I was standing outside on the phone he came out n drove off. he went missing for the whole day n night and was the following day police got a hold of him. ENOUGH TIME FOR HIM TO SOBER UP. but police questioned him and to my amazement he denied it and also the witness was somebody who was obviously in the middle of some kind of money/business deal with him because she disappeared too. I repeatedly phoned the guy then threatened to go to his house and speak to his wife and tell him what he done. what I got was a police visit telling me to stop hassling him and their was nothing they could do. the cost of the damage to the car I had at the time was £600 all in which I had to pay out myself :(. My point is don't make things any more complicated than they are or you will just stress urself out more. Get you are car sorted n let insurance deal with chasing the other driver for it. they probably wont get a penny out of the other driver coz the other driver is under no legal requirement to pay you are insurance company. if the driver is going to court for drunk driving then sort out you are damages n get the cost to the fiscal before the court case against the other driver happens. bit of a nightmare. good luck.

Yeah, I've been on the phone plenty. It sounds like it's going down as a total loss, I lose my NCB. But funny enough, I've just got a quote with 1NCB, and 1 accident and it went down £200.

The way it's sounding is that it's going to go smoothly, leaving everything to the legal people. Which I'm certainly happy with.

you'll only get anything if he has any cash or assets, if he's scum and doesn't have anything to his name the only likely outcome would be a fiver a month out of his dole (if you're lucky).

if you have legal protection ask them to advise you on what to do, they will offer better advice than anyone on the forum will as it's their job to make sure you don't loose out.

sorry to see this!! seem's same situation as the crash i was in, a drunk driver went straight across a junction and flung me and my mate head onto a tree...i was in a 2 day old mk6 golf! he ran from the crash and was later found when he was sobar. cooooooonts on these roads...

had a slammed nissan micra turbo ford ranger 4x4 jacked up truck came flying through a red light drove stright over my car i was stuck in side afta that i woke up in hospital was there for neali a month neva came out and it went to court other bloke had drink driveing against him plus band driver and some other stuff but he got off with it as he was 63 and i was only 19.. the judge said younger drive up to the age of 30 bring it on there selves i lost everythink a month of my life my car and my insurce was so shit i had to pay court cost still have the letter here to say i wasnt at fault tho.

Unfortunately its always the good guys that get screwed over. When it comes to no insurance he will probably get a slap on the wrist and have to pay nothing where you will be left out of pocket. Its frustrating and shouldn't happen.

That sucks mate. Obviously worked hard to save up for a decent car like that, and then some ignorant sod decides he is above the law and doesn't need insurance ruins everything. Just ruins it for everyone. Hope you get all the advice you need and manage to recoup something out of it mate

Speaking to the insurance, I'll get a figure Monday. I imagine they'll want to give me trade price, but try and find a Fabia vRS for trade money...

I've been transferred to specialist in uninsured drivers, the case will now go on three months I believe before any personal damages will be paid out. Fun times.

I saw a '90s Shogun tap a MK2 Golf 5dr at a junction, not a mark on the Shogun, literally not a mark.

Both back doors had burst on the Golf, the thick rear pillars had both pushed the roof right up, the passenger compartment was folded up.

Ladder chassis v monocoque.. no contest.

Just got the report... £3,080! They'll give me. Wait for it, minus my excess of £450.

Leaving me with £2,500 to buy a car that up here in Aberdeen you cannot find for less than £4,000.

That's true. I will dispute it but the woman told me that there is very little chance of getting any more.

It's just a ridiculous run of events, I have 30 days to insure another vehicle with my insurer, my compensation claim which will return me my excess will more than likely take around 3 months.

I've just sent an email asking if they could forward the detail of the vehicles that are within my post code. Should be fun too see what I get back.
