Hello all,

I was registered to this forum a while ago (2 years ago apx) and sold my red polo on here (see thread below).

I have now had a letter from the DVLA and debt collection company COLLECTICA about a late tax disc payment from September 2012 and am being threatened with legal action.

As the car was sold almost 2 years ago, I do not have any of its related paperwork and did fill in all of the VC5 documentation when selling it - where does the fault lie here? I cant get any information out of the DVLA, and cant contact the user in question via the forum (either that or I'm being ignored?)

Any help and advice would be greatly appreciated.

Even if you did send off the paperwork to the DVLA. According to them its still your fault dont ask me why they just put everything back onto you. Id phone them up and explain the situation and see what they say. Please let us know how you get on.

By the way my dad had a letter a couple of years ago threatening him with legal doodahs then when they said the reg number he said I've never had a car with that reg number. After a lot of tooing a throwing they said we will let you off this time??? How he never did anything wrong in the first place the DVLA cocked it up.

Being able to get hold of user Finchyboy_123 would be a great help, according to DVLA the car is 'unregistered' ... which doesnt help me at all as I sent off the VC5 docs.

Have found a fair few articles stating that I shouldnt pay this fine, my worry is that it is now being handled by a debt collection agency and they will not listen to appeals etc.

Any further advice would be greatly appreciated.

Looks like finchboy hasnt been on here since March this year mate.

Call up the DVLA there useless bastards at the best of times.

Hope you get it sorted.

Did you send off the V5 when you sold it, or the new buyer?

Did you have a confirmation letter of change of ownership?

About the scariest thing a debt collector can do is knock on your door and ask you for the money, but realistically, all they can do is write to you and phone you. They are not bailiffs.

Tell them the matter is in dispute and they can't do a thing.

Write to the DVLA. Tell them in no uncertain terms that they are mistaken and why. Tell them that their agents are unlawfully harassing you. Tell them to stop writing to you immediately, or to take you to court. Also tell them that if they continue, you will be counterclaiming for your costs involved in dealing with their false and spurious claims.

However, the DVLA have taken me to court, the court in the first instance found against me, but at a later hearing, the verdict was struck out, and the DVLA given time to bring their case again, which they never did. No one "won" as such, but it cost me two mornings of my time, and I'm sure it cost them a heck of a lot more.

Have followed your advice, as I haven't had any previous letters from the DVLA I have written to them (recorded delivery) stating that I would a) like all information relating to this case and b) that I have no intention of paying until I am fully briefed on what I have done wrong (I explained that I sent all paperwork and that I have had no previous letters from them and that this letter from collectica is the first I have heard of this matter).
