i dont think its as bad as it looks ,if you say find me one,same age mileage and condtion you may have a case what mechanical damage is there

The pictures do the damage justice to be honest.

The B pillar is crushed in quite a bit and you can't see that in the pictures, it would be a shit load f work to get the shell back to a decent condition.

Still waiting to here from the insurance to see if they are writing it off or not, hopefully I will get a decent pay out, I will not be excepting a stupidly low amount.

I was doing around 35mph

I worked for Swift cover and dealt with cases like this when our engineers would under value the car. My best advice is keep rejecting their offers. Legally they are meant to put you in the same financial position as you were before the accident so if you've spent £3k on it and believe its worth £3k then let them know. (Also if you bought your car fairly recently and have your receipt / write one out yourself then that can be used as a good bargaining tool)

As much as you argue insurers won't give you more than the maximum Parker's guide valuation unless you provide them with evidence that your car has been modded or has an increased value.

Keep rejecting until the point you get bored / give up or happy.

Ask for your case to be given to the senior engineer so he can review it and speak to him if you can (don't talk to the clowns who answer your call, they have no authority to increase your valuation so speaking to the assessors/engineers is best), if still nothing threaten to take them to the financial ombudsmen (this will usually mean that your complaint will be passed to the most senior management dealing with fault claims, and your arse will get licked)

They will usually ask for you to send like for like examples of other cars with similar valuations to yours, if you want, steal some pictures off the internet and create a couple of Gumtree/ forum for sale ads at £3k with similar specs to your car and send them in (this probably could count as fraud so be clever)

If after all this they wont budge take them to the Financial Ombudsmen, who will impartially review your case and usually side with customers in my experience.

I doubt it will ever get that far though as to insurers £3k is nothing for a claim and they will usually just pay out rather than have the complaint against their name

Thanks for that advice mate it should come in pretty handy.

They have already said to me that they do market research to find out the market value and don't just look at the book price.

Engineers report should be up tomorrow so I am expecting to have a long phone call then.

I also contacted the guy I bought the car off today, he was gutted when he found out, but he is going to write me a receipt, sign it and send it me.

I was unaware that legally they had to put me in the same financial position that I was in before so cheers for that.

I've been unlucky enough to have a couple older cars written off by Third Parties in the past.

Nothing as rare as a Polo G40, in my case it was a Polo GT and a BMW E30 325i.

As both cars were over 15 years old the third parties insurance just asked me what I paid for them and gave me that back, no hassle or anything.

Depends on the company though, hope you get a decent payout though. Good luck!

Insurace company has the right to act in your name so basically the decide whether you are liable or not.

At first the women was saying it was 50/50 but when she rang her insurance and explained what happened they have probably said to her it was her fault and to accept liabilty. Seeing as it was my right of way, I was traveling down a main road and she didnt indicate or look.

I feel a bit hard done by now seeing as I have been forced to pay high premiums since i started driving because I am a young/new driver.

Then I get hit by a 40 year old women how has probably been driving over 20 years, lifes a bitch!

I imaging with that damage they will try to write off the car. How did the drivers rear wheel become damaged?.

You need to start getting adverts for other similar cars and fight you case for a similar pay out and yes you have the right to be put back in the same financial position as before the accident. I would also get quotes from some garages to estimate the cost of repair so you know what it will cost you to get the car back on the road.

Got hit on the passengers side and it pushed me into the kerb on the drivers side which smashed the wheel and bent the rear beam.

Still not heard back from them yet, the thing is it is so hard to find adverts for G40's that are not on forums, there are loads on club g40 from past and present though. There are also 2 on ebay atm, 1 for £4000 and 1 for £3500. None on pistonheads, car and classic, gumtree or autotrader.

That's fine they should accept forum adverts and ebay.

There was that G40 on pistonheads being sold by 4 Star for £6000 that would be worth digging out! :)

They have wrote it off as a cat-b! So it can't go back on the road again.

They offered by £500 if I was to keep it, I said I cannot accept that as i paid a lot more.

The have asked me to provide evidence that it is worth more so I have sent them a load of links to adverts all over the internet past and present.

Hopefully they come back to me with a better offer.

Gutted for you mate, must be a lot worse as the pictures suggest.

How much are they taking off so you can keep it like?

I'll bet it is a percentage so the more they increase the offer the more they will 'take back' for the scrappage.

Ask them to find you another one of similar spec/condition for £500...

they have to return you to how you were before the crash,

this would leave you worse off so is unaceptable

Stick to your guns- ask them to find you a replacement in the same condition, they are paying out no matter what as they have accepted liability now. Tell them you will not be left out of pocket due to there clients negligence- if they do not pay what you ask then you will add on the cost of a hire car until they do.

the insurance company seem to be dragging their heels saying that my evidence is still under review

got my eyes on another g hopefully I can get the money together in time

not 100% sure what will be happening with this one, but its not just gonna get scrapped every last part will be stripped off it and either sold or re-shelled (like I've previously said)
