I received this letter to say my vehicle is also involved in the scandal...

I have this car on solutions pcp so I either make a payment of 3000 at the end or get another vw part ex.

I wanted rid of this car for a bit now so I can just buy a second hand reliable car for a couple grand and not make payments every month..

Am I in a good position to return this vehicle because as far as I'm concerned they have breached the contract?

I was afraid before that I would owe money if I returned the vehicle because I would have probably paid off less than the cars value has depreciated. (If you get what I mean)

But at the same time why should I stick to this contract if they have breached it and lied about the car when I bought it?

Apologies if that is all hard to understand I am not the best at explaining things.

Problem you have is you do not take up the contract with VW you take it up with a 3rd party so they will mostly likely just tell you that's not there problem then you'll have to pay the value equivalent if you haven't paid its worth to leave the contract

When they rectify the issue - will the cars have slightly less bhp? It will be interesting to see if there is a slight performance loss.

I don't know if you would really have a case as this isn't a dealer issue and your finance will be through a 3rd party who probably won't be interested in anything other than getting their money back from you.

If you did decide to put your car back it is likely you are in negative equity and depending on how this has effected the value of VW cars probably even more so now than if nothing had happened.

Thanks for the responses guys...I had feared that it wouldn't make a difference due to being a 3rd party controlling the finance. I may be mistaken but I was sure vw had done the finance too like vw finance Ltd or something..I'm trying to find all this stuff now if only I could remember where I put all this stuff for the car.

The bluemotion has claimed amazing emissions which are even better than the standard 1.2tdi which also was involved in the scandal..I would definitely imagine power will be affected due to this as they surely have to fit even more restrictive cats or more of them.

I would assume it would just be a case of remapping the cars so they always produce the emissions stated....but obviously this will have an effect on power output.

Would be interesting to do a before and after comparison.

On a side note anyone noticed the price of diesel has risen by 2-3p a litre in the last few days?

Hopefully I won't have to do a before/after lol even if I pay say 500 quid to let the car go I'll be up for that to get a better car which costs less money.

As for the diesel at central London driving to work I noticed shell was 113.9 a litre and they were the only ones who had a price rise and now all others in my own area just out of London are about 111.9 or 112.9 which is still an increase from a month back at tesco it was 109.9. Bit of a bummer really as I thought it would drop more but you watch it rise up again by next year to something silly.

I have just found my finance agreement paperwork and it's done by volkswagen finance services (UK) so there may be a glimmer of hope.

I can't find anything in the contract with guidelines to what my rights are if the vehicle has been sold with false specs or anything similar. .surely there is something though it can't be just a one way contract although that's the way it looks at the moment

I'm in two minds what to think as there is always different aspects to the case for and against but she is taking all my paperwork to work tomorrow so the lawyers there can look over it and see if I have a chance...

Bit bummed as I have to pay for two tires on my service tomorrow and an mot this month so I wish this could have all been sorted at a sooner date

The first thing that comes to my mind is yes you're correct...but VW have openly admitted their mistake and are going to take actions to rectify it which 'should' have little or no effect on you or your car. I'm not saying it isn't worth a try, it is. But I would imagine VW will have already had their lawyers go through all their finance agreements so they have answers at the ready for anyone wanting to do the same.

Yes you are right there, although there isn't a clear solution to fox emissions yet they will have it soon and have already stated it meaning that chances have slimmed a lot unfortunately.

Had I knew my car was affected before and said something before they had sent this letter I am sure that I would have a greater chance

So have you kept a careful log of fuel consumption that you can submit as evidence to the court and do you have a sales brochure where the salesman underlined the manufacturer consumption figures and crossed out the "your mileage may vary in real life" disclaimer paragraph?

In a PCP the end payment is also known as a GFV or Guaranteed Future Value. The car will never be worth less than that end value according to the agreement. Get your finance documents and take a look. The only thing that can devalue the car lower than that final payment is damage over and above "fair wear and tear".

You can hand the car back with confidence. Unless there are scuffs and scrapes etc that need sorting.

Moan and make a fuss, do whatever you have to to get rid of the car. I wouldnt trust vw to tell you if you can return it

@dvderlm I haven't no, I wouldnt have really thought it was an important factor as the main thing is the emissions being higher than the claimed emissions from vw on my model, I'm not even sure with fuel consumption that I would stand any chance fighting it because they could blame it on driving style etc lol

@dougstar That is a very very good point. I'm pretty sure though that in my documents it states I need to pay ex amount off before I can return it (around 3800 I think it was) so far i have paid 1700 off the car. I would look at my documents but there with the lawyers being checked atm and will have them back tonight

@kiran I went today to VW for my service and MOT but i have held back for now till the lawyers get back to me about my finance papers, I did however speak to somebody to ask what will happen to correct the emissions and the simple answer they gave me was they dont know...Volkswagen have been very vague with the slough branch and said that they plan to have a solution and recall in January. Sounds to me like they have not got a clue how to fix it yet perhaps without reducing power output or something...End of the day ECU software changes will only increase/reduce emissions which will also effect power output as will a more restrictive CAT etc. so god knows, that could be a good case though because january is a long way away and saying they will fix it is not good enough. They need to assure me that they already have a plan. not they hope to have one by january!

With the ECU I'm not sure a reprogramme could get my emissions that low without having a drastic affect on power output, in that case I definitely wont be happy with it, but one of the reasons I got this car was due to the free tax for low emissions, I wont be happy if all of a sudden I have to start paying that

Was an interesting read nige cheers for that. Only time will tell what performance affects it will have then. Hopefully I don't have my car that long to find out lol

A slightly unrelated update with the new polo. They sent me a video and called me regarding the mot which it obviously needed two front tires for and I already knew that. But they also recorded a diesel leak which was dripping almost twice a second and the cost for inspecting the leak and cleaning the tank to find it is £66 and that is before they have added on any parts they want to charge me with to fix it. (I'm hoping non wear and tear and then warranty would cover this). total cost of tires and inspection so far is 188.60 and then 39 for the mot too.

Call me suspicious but I ran the polo for 30-40 minutes on my drive yesterday to charge the battery on my breadvan whilst I sorted some stuff out in the house. When i came out i disconnected jump leads and put the polo back in its place at the top of the driveway and there was most definitley not a puddle there. I know because I jet washed the drive from when my breadvan leaked oil previously ten minutes later. I also notice things like that a lot and I am very observant with my cars so I find it very wierd if it hasnt been tampered with and i just somehow didnt notice this. (also to add...my fuel consumption was completely fine the whole time. and with the rate of drips and the driving I do I cant help but think i would have emptied the tank a lot faster than i have been)

Anyway I called them and they said it was already there so theres just my word against theres lol. Is this really a thing that a main dealer would do? I keep thinking I must be mad to accuse them of something like that.

I would ask to see the leak first hand with the car on the ramp before you agree to any work. You may spot something that they have 'missed'.

If the tank does need to come out or it isn't just a simple fix I would push hard to get the repair done through warranty as a fuel tank and lines should certainly last more than 4 years on any car.

Why are you suspicious yourself? Have you had a couple bad experiences?

This is the first time anybody has worked on one of my cars other than me and only because of it being new and under warranty with a service plan.

I've called to come down and they have said that the car is off the ramp and other cars are waiting to be done before tomorrow too. But have also said not to worry because almost everything in the fuel system except filters etc are covered. I'm waiting on an answer now to say if I have to pay the 66 pounds for the inspection or if I can get that as part of the service charge which is free

what also made me suspect was that surely they would continue the mot and inspections etc to find out the problem before they out someone elses car on the ramp...

Not really bad experiences just spoken to enough garages to know when I'm being fed a load of bull. I've also been asked to tag along with people putting their cars in for repair at main dealers and been able to call their bluff a couple of times. They have a great ability to make a simple job sound complicated and focus more on the worst case scenario.

Back to your car, have they just completed a service on it? Did this include a fuel filter by any chance?
