Well a old dear crashed into me a while ago, it was her fault and she admitted fault. Damage is broken bumper and dented wing, i havnt fixed the car and have been driving it the same as it was after the accident as its perfectly safe and legal to drive.

I had my vehicle inspected and after a month and half of hearin nothing from her insurance company i rang them up. They said my car is a total loss and offering me 161.50 and i keep the car. So my car will be a CAT C write off. However i will not be accepting this offer as its worth much more than that.

Am i right in thinking that until i have accepted a offer from them they cannot write my car off? So i can still drive it until they make a proper reasonable offer?

Yeh if u decline the offer then nothing is settled so the car cannot be written off yet!

check with the DVLA too...sometimes the insurance company can write to the DVLA requesting them to write it off, but i don't know for sure.

I'm in the exact same position Andy, my accident happened on the 17th August and after all this time of him not accepting liability it turns out he dosent have a leg to stand on (good news for me)

Got my quotes and they say it will probably be a write off!!!

got even worse, they closed the file even tho i told them i wasnt excepting the offer bunch of useless t**ts.

Have you sent the insurance the V5 log book?

naw i havnt sent anything off and I'm still driving the car. I didnt go thru my insurance company as they offered to do it without. They are now re-accessing my vehicles value. I fthey mess me about anymore i will be ringing citizens advice and contacting my insurance company.

hi mate dont give the insurance people the v5 or logbook give them photo copies

also when you accept the right offer make sure it includes that you can continue to keep the car

if not they have a legal right to the car if you accept any offer without agreeing that you want the car

when you have recieved pay out from the insurance company your cat will be classed as cat c insurance right off which means that you need a a vic test to prove the car has been repaired and safe to return to the road if you look at dvla website they would explain what i mean good luck glenn
