The other half had a minor bump in a carpark this morning where she caught the side of a car while parking. Apparently the bloke whose car it was didnt have permission to park there as its a school carpark owned by the school for staff only. if the guy insists it goes through insurers will they payout if he was there without permission.

Good question. Aaaand,i dont know. Its worth a shot,she could tell her insurer,but i doubt they'll persue it. Might just be worth asking a solicitor if she has a case,just to see what side the law stands,even with no intention of going further?

your insurance covers yourself against things which you do regardless of where you are. (unless specifically told - ie motorracing)

being on private land with someone you hit makes no odds, imagine that someone hit your car while you were on someone elses drive. you shouldnt have been on the there drive - but you were - and they hit your car.

hence its there fault for hitting you - they should have looked!

Makes sense. You spend quite alot of time driving on private land,such as the Tesco's car park,petrol stations etc.

I see what your saying here mate but i suppose tesco and petrol stations may be privately owned but they are open for the public to use so i guess you would have a right to claim.

The car park this guy was on is owed and funded by a school. There is a sign at the front stating it is private property and any unauthorised access risks prosecution.

I wouldnt normally have a problem paying out if i was at fault in an accident, but this guy was very aggressive to my girlfriend who was very upset and alone at the time. Bit shitty really.

Anyway thanks all for the comments and I've just sent off all the forms and stuff to the insurer so its upto them now. will update on the outcome.

Insurance used to apply to public highways only, but now it extends to private land too. So your girlfriend will be liable I'm afraid.

Only good thing is that girlfriend is definetly more careful when parking lol
