i'm sure some of your remember the palava i had a few months ago about getting stopped by police, getting penalties for both front tyres, number plates etc and being within two years of driving, WOULD have my licence revoked...

well i had a genuine story, was on my way to getting my tyres changed an have all the proof to prove this, so i sent off for a court summons a few days after.

I was stopped on the 19th of March 2007... an i must of sent the court summons off on 24th or sumin

basically, do they have a time limit as to how long they have to reply back to me with a court date or sumthing?

i've received nothing and its mid-june now!

i think it can be any time upto like 3years iirc ?

think about how many they must get and have to sort through...

Yeah, 3 months is nothing. I would imagine it would take at least 7-8 months for a summons.

If you have proof, as you say, you may well get away with it,but it if a car is illegal, its illegal.

I thought it was your duty as the owner of the car to have the tyres replaced BEFORE they are illegal and not let them run down to be illegal and then change them.

Tbh, once my tyres start to look a bit ropey I like to have them changed. Not a big fan of rolling on baldies.

True, If I was a magistrate I would just argue that in order to stay on the right side of the law you should have removed the wheels from the car and had them rewrapped at a garage seperately before driving on them again.

Most motoring offences like the ones you commited regarding the tyres are Strict Liability offences.

Meaning if you had tyres under the legal required depth, your guilty.End of. Theres no defence to strict liability offences,as someone else said, you have to replace them before they get that low.

The police wouldnt prosecute unless they are certain they would get a conviction.

the limit that they can do anything is 6 months, cos i got pulled on X-Mas day for dangerous driving (whole other story) and they had until june 25th to do something about it, and nothing, so its all cool i think

Summons
Most Road Traffic cases are commenced by way of a summons. Any information must be laid before a magistrate, the justices clerk or person designated by the justices clerk as having the delegated power to accept the information. The form the information should take is detailed in the Magistrates Court Rules 1981. The information should contain a description of the other offence, and give reasonable information of the nature of the charge and should refer to any provision creating the offence. The information needs to be laid within six months of the date of the offence.

Time limits
The general rule for indictable only offences and indictable offences triable either way is that there is no limit for commencing proceedings.

For summary offences section 127 of the Magistrates Courts Act 1980 provides that except where it is expressly provided in legislation a magistrates court shall not to try any information unless the information was laid within six months from time when the offence was committed. Section 6 of the Road Traffic Offenders Act 1988 provide for time limits within which summary proceedings for certain road traffic offences must be commenced and gives exceptions to the 6 month rule. Proceedings for offences to which the section applies may be brought within a period of 6 months from the date on which evidence sufficient in the opinion of the prosecutor to warrant the proceedings came to his knowledge. No proceedings can be commenced under the section more than 3 years after the commission of the offence. When deciding whether or not the 6 month rule has been broken, account should be taken off who has the authority to prosecute.

if you can drag the process out for long enough the fuzz will normally just drop the case cos it becomes no longer worth the effort (the police get too many people who just pay up to give a monkeys bout the ones who wanna make it hard work for them.) I'm still of the opinion that there is no excuse for driving on bold tyres. it doesnt take 5 mins to check them once a week and it could stop you from having a bad accident ( i once found one of my tyres (front pass side) had developed a bulge, which could have been nasty if it had popped at 70mph) dont scrimp on tyres its not worth it!

i was stopped for speeding in december 2005 and received my second set of 3 points, and didnt get the court summons for it until mid july 2005. i was gutted cos in august i would have had my license for 2 years. so I'm sorry to say it, but youre not off the hook yet.
