Right got pulled over this morning on my way to work at half 6! Bastards made me late for work.

They pulled me because my car flagged up on their system. Someone has put in a complaint about me on the 6th December saying I was driving dangerously.

Jist of it is I over took this bloke at 6:45 on tuesday the 6th and he thinks that I crossed onto the wrong side of the road and went the wrong way round a pedestrian island to overtake him.

I have admitted to overtaking him he was doing 20 in a 30 and I was running late, nothing else on the road, so i sped up and went for it overtook him as quick as possible then just sat at 30 in front of him (all in all very pointless but still), obviously thats how he got my plate.

Just now i have been cautioned and warned that i might recieve an NIP for this to be charged with dangerous driving.

Just wondering if the case would even stand in court, the guy who reported me has no witnesses that i am aware of but i had my mate in my car at the time. So to me it looks like 2 against 1.

I cant afford to get any more points, I'm on 7 already and just got my licence back from having it revoked.

Anyone had anything like this?

Also found their dates and time to be wrong.

6th December was a Thursday not a tuesday as the 4th was a tuesday.

I left my house on thursday at 07:20 and on tuesday at 06:50

So on both days I wouldn't have got to the area the incident took place at all on thursday (as i dont go that way) and on tuesday till about 07:00.

It's because you drive a Saxo with a jap can, you'll get plenty more of these letters.

Which at the moment sounds like a scooby as its only firing on three cylinders. Coil pack is giving up the ghost big time!

if there is no video evidence or witnesses they have fuckall think they just wanted to scare you into being more carefull in future.

yup hes just trying to scare you.. i had the same thing because my mate threw a coke can at some car we were overtaking (pissed out of his face being a idiot) and they said exactly the same thing when they pulled me.. nothing ever happened

If it goes to court you need excellent character references, granted driving record doesnt help..I'm not judging as I'm the same lol....and also see if you can discredit this guy..he may have a record too. That is one of the best things i've heard in a long time! But still, with no real evidence to go on i dont think it will go any further tbh.

Carrying on from this I recieved my N.I.P. (notice of intended prosicution(sp)) today. So what do i do now? Just wait? Never had one of these before.

i can't see how they'd prosecute you when it sounds like it was an old duffer in the car (unless he's a copper of course!) and without video evidence, how can he prove you were driving dangerously?

Sounds like one of these people who have nothing better to do than whinge and moan all day!

Tbh, i wouldn't worry. Ask for the evidence he collected and if its just hearsay, you'll be fine!

Ahh mate was a pickle indeed...like i said that little quote may help...go to a free legal clinic if they have one at a local solicitors that specialise in motor offences....worst thing that can happen is more points...as long as it aint 5 or over your ok..well your not but u have a licence still....lol i wish i had covered this stuf at uni already, i could be more useful

Yeah I wont be happy even if i got just 4 points and kept my licence. My insurance is sky high already and thats with 7 points, if i phone them up and say i now have 11 they will bend my over and give me a right good seeing to.

But then again they have no evidence and any offence i did commit on Meethill Road wouldn't have been on the 6th Decemeber as its a Thursday and I only go that way on a Tuesday.

Just thought, the police pulled me on a Wednesday going my normal route to work (none Meethill road way, where the "offence" took place) could that be used to my advantage in court?

Bit risky, epsecially if any part of your route is covered by cctv of any kind. I dont see how this could work without evidence, although i know reasonable suspcision is enough to uphold a conviction unfortunately...did you say you had a mate in the car or am i confusing that with another post. Yea your insurance is likey to give it you hardcore style if you get anymore points. hmm, i am keen believer on road offence justice now...I'm having a law day tomorrow, i will see what i can find, anything to get my out of an essay on Constitutional Law lol.

I pick up my mate only on a tuesday hence the reason my roue differs slightly from the norm, and my mate can remember that day and i did not do what I'm being accused of.

I aint got no dates for anything yet just a notice of intended prosicution nothing set in stone yet.

I have no idea who reported me so i dunno if he resembles part of a womans anatomy but i guess he is.

I'm not a complete arse I wouldn't sue anyone for incorrect advice, because after all its just advise but i have the final say in what i do.

Lol I'm not saying you are, or you would lol, and true you dont have to beleive anything i say or listen to it i just put that for my own purpose lol. My name is Leanne btw...and I'm reading some stuff now, but to go to court you do need a solicitor, and a damn good one to go against the CPS. Where do you live?

As already said go to court and see what evidence is offered against you, its very likely that you'll be paying for your own solicitor as most non imprisonable and motoring offences dont come under the duty solicitor scheme. You could ask for an adjournment untill you've recieved legal advice or (may not be the same in every court !) you could ask to talk to the legal clerk and get a bit of free advice. Obviously your taking this very seriously as you know that a conviction for dangerous driving would mean your licnece being revoked and getting it back would mean you taking an extended test. Although we're obviosly not aware of all the details in your case its seems (as already said) that it would be a very hard case for the CPS to get a conviction out of it if its based on the evidence of one person and unless he was considered by the court to be an expert wittness then his evidence wouldnt be given any more wieght than your own. I have hear'd of cases like this being dropped on the day by the CPS as it would not be in the public interest to continue, but as said I can only comment on the cases I know about. If it does get to the point of you having a trial you obviously want the best legal advice you can get and if you have the money you could do a lot worse than contact these people :- http://www.motoringlawyers.com/ I have been in court when Mr Sylvester was deffending in a few cases and although I dont like the bloke his knowledge of the road traffic act is second to none and if I was ever in the shit and didnt feel that I could manage my own deffence I would use them.
